Book Description
Excerpt from Law Magazine, or Quarterly Review of Jurisprudence, Vol. 28: For August, 1842, and November, 1842 Moreover, when we remember that the great body of prisoners are illiterate persons, few of whom can afford the means of securing the assistance of counsel, it is palpable that any system which curtails the length and simplifies the form of indictments, and renders unnecessary the multiplicity of counts, must be productive of no trifling benefit to the unfortunate beings who stand at the bar of a criminal court. For what object can be witnessed more painfully ridiculous than the sight of a poor wretch, who can neither read nor write, and whose humble powers of apprehension are con founded and almost paralysed hy'shams and fear, yet striving in vain to collect the real charge against him from an indict ment of perhaps fifty folios and twenty counts, dressed up in the most approved confusion of Special pleading verbiage? Is it not treating common sense like folly, to say that such an indictment can give any information to such a person? Book Description
Excerpt from The Law Magazine, or Quarterly Review of Jurisprudence, Vol. 30: For August, 1848 and November, 1848 The practical result of ten years' labour lies before us in the shape of the seventh and final Report of the Criminal Law Commissioners; and we venture to affirm that no document has been presented to parliament for many sessions, containing matter equally interesting and important with that which is supplied by the present volume. The Commissioners are not content with simply expressing their strong conviction that a condensation of the criminal law is not only practicable, but highly expedient they have acted on that conviction, and have embodied in a single statute the entire digest Of that branch of the criminal law which comprises crimes and punishments, in the hope that what has been done may serve at least as the basis, on which such a system of criminal law may be constructed as is best calculated. Book Description
Excerpt from The Law Magazine, Vol. 21: Or Quarterly Review of Jurisprudence, for February, 1839; And May, 1839 Our object (he continues a little further on) n the following Course, is to produce a learned and accomplished lawyer; and, perhaps, we may say, to aid the researches qf the counsellor, the judge, and the statesman. We have selected, with our best judg ment, from an infinitude of works in every branch of the science, and have in no instance recommended a single work, or even chapter, or page, which could with propriety have been omitted. The course, we acknowledge, is extensive, but can be thoroughly accomplished, we compute, in six or seven years, making due ai lowance for other necessary reading. Book Description
Excerpt from The Law Magazine and Law Review, or Quarterly Journal of Jurisprudence, 1871, Vol. 30 T no remote period, our patent laws will engage the attention of the Legislature, and upon its right deter mination respecting them depend the interests of that large class of inventors which England has the good fortune to possess, and whose genius and perseverance have done so much towards giving her that supremacy in manufacturing industry which she has long enjoyed without dispute. Some of us are perhaps actively connected with manufactures which have been created and improved by inventive genius, and which are still capable of greater improvement. Others, perhaps, only take a general interest in the subject, and yet that general interest cannot fail to be a deep interest, if we realise the effect which enterprise of this kind has had upon the welfare of the country at large and of ourselves indi vidually, by cheapening and improving articles of utility and of daily requirement. Whether the patent laws should be amended or abolished. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. Book Description
Excerpt from The Law Magazine, or Quarterly Review of Jurisprudence, Vol. 55: February, 1856 Mated tone of voice, he tood erect, and was by no means wanting in that energy of manner and action so useful and becoming in a mixed popular assembly. Indeed he was a splendid exception to the general rule, that lawyers fail as orators in Parliament. As a specimen of his forensic abilities, I need only refer to one of the many of his reported Speeches, on behalf of the plaintiff in the well-known case of Huguenin v. Baseley.1 I may add that he was a great master of sarcasm, and did not fail to use it on a fitting occasion; but that, as a general rule, he considered it an unfair weapon, and only to be sparingly employed.
