J.-i Vi. nor Courts. is undecided, as to the power to sue in the County Court upon a judgment recovered in a Superior Court. We are not now referring to proceedings under section 98, but to a formal action for the debt. The doubt was suggested by the Court of Exchequer, 7; Cox in the case of Peirce v. James (1 Cox & Macrae, 45), & Macrae, but, unfortunately, it was not decided, for no cause 45) being shown, the prohibition went, as a matter of course. Its importance requires that it should be given entire. The plaintiff in this case had obtained a judgment in the Court of Exchequer for 18/. 19a., upon which he had brought an action by plaint in the County Court, under 9 & 10 Vict, c. 95. The defendant had pleaded nul tiel record, upon which the plaintiff produced an examined copy of the judgment, which was received in evidence by the Judge. Nayhr moved for a prohibition.--It may be stated as a general rule, that Inferior Courts cannot try actions upon judgments in the Superior Courts. It is laid down in Comyn's Digest, article "Prohibition," A. I, that a prohibition lies if an action be brought in an Inferior Court upon a judgment in the Court of Queen's Bench, citing an anonymous case in 1 Roll. Rep. 54, where a plaintiff who had obtained a judgment in the Queen's Bench for debt and damages, brought an action upon it in the Court of the Tower of London. The defendant was taken in execution and rescued, and the plaintiff brought an action on the case in the same Court for the rescue. But the Court of Book IV. Queen's Bench granted a prohibition.
