Such cases are always in a sense tragic. And what is called for, in our pluralistic and conflictual world is not to be found, as many would suppose, in an impersonal set of procedures with which all participants could be treated as having rationally agreed. The very idea of such a neutral system is an illusion. Rather, what is needed, Julen Etxabe argues in this book, is a heightened awareness of the difficulty of judgment. The Experience of Tragic Judgments draws upon Sophocles’ play Antigone in order to consider this difficulty and the virtues that attend its acknowledgment. Based on the transformative experience that the audience undergoes in engaging with this play what is proposed is a reconceptualization of judgment: not as it is generally thought to occur in a single isolated moment, like the falling of an axe, but rather as an experience that develops in and through space and time.

This study breaks with traditional readings in terms of tragic model and tragic hero in the works of Racine and Corneille. It departs from the critical tradition of examining the tragic hero as an isolated figure, defined by autonomy; it approaches the behaviour of Médée, Clytemnestre, and Phèdre from a relational perspective. It argues that these female characters belong to the tragic hero category, hold valid and valuable ethical positions and deserve to be treated as equal to their male counterparts. It also redefines the way we look at the tragic dynamic. The characters are no longer antagonists but inadvertent collaborators working towards the tragic outcome in order to satisfy desires and beliefs about themselves and the world that are deeply rooted in their psyche. This book shows that alternative interpretations of the behaviour of Médée, Clytemnestre and Phèdre can be obtained and must be obtained by applying modern methodologies in order to challenge the biased readings from the past and to see these characters in a new light.

Facing Authority investigates the ways in which this question of legitimacy can be addressed in theory and practice, in the face of disagreement and uncertainty. Instead of asking "what makes authorities legitimate?" in the abstract, it examines how the question of legitimacy manifests itself in practice. How can we distinguish whether a regime is legitimate, or merely purports to be so? And what does it mean to do this well? In its case law on the use of lethal and potentially lethal force, the European Court of Human Rights declares a fundamental connection between the right to life in Article 2 of the European Convention on Human Rights and democratic society. This book discusses how that connection can be understood by using narrative theory to explore Article 2 law's specificities and its deeper historical, social and political significance. Focusing on the domestic policing and law enforcement context, the book draws on an extensive analysis of case law from 1995 to 2017. It shows how the connection with democratic society in Article 2's substantive and procedural dimensions underlines the right to life's problematic duality, as an expression of a basic value demanding a high level of protection and a contextually limited provision allowing states leeway in the use of force. Emphasising the need to identify clear standards in the interpretation and application of the right to life, the book argues that Article 2 law's narrative dimensions bring to light its core purposes and values. What can law’s popular cultures do for law, as a constitutive and interrogative critical practice? This collection explores such a question through the lens of the ‘cultural legal studies’ movement, which proffers a new encounter with the ‘cultural turn’ in law and legal theory. Moving beyond the ‘law ands’ (literature, humanities, culture, film, visual and aesthetics) on which it is based, this book demonstrates how the techniques and practices of cultural legal studies can be used to metamorphose law and the legalities that underpin its popular imaginary. By drawing on three different modes of cultural legal studies – storytelling, technology and jurisprudence – the collection showcases the intersectional practices of cultural legal studies, and law in its popular cultural mode. The contributors to the collection deploy differentiated modes of cultural legal studies practice, adopting diverse philosophical, disciplinary, methodological and theoretical approaches and subjects of examination.
