Of law in general, considered as an essential feature of political society and abstracted from all definite systems of law, there is a universal science known as General Jurisprudence; and of every system of law, differing as each does from every other in some of its exterior characteristics, there is a special science, - the Particular Jurisprudence of the State in which that law prevails. Thus American Jurisprudence is a special science, treating of the laws of the United States and of the States of which the American Union is composed. Manifestly some knowledge of this science is important to every educated citizen who aspires to the intelligent discharge of his political duties; a more intimate acquaintance with it is indispensable to the lawyer and the judge who participate in the interpretation and administration of the law; while for the jurist and the legislator the mastery over it must be still broader and more profound. When we do an act, or forbear from doing an act, the act or forbearance is the consequence of a desire in our mind. Our desires are regulated by motives. Now, what the sanction of law really does, is to furnish the party commanded with a motive, viz. The motive of avoiding an evil. But a man cannot be obliged or forced to desire or not to desire; that is to say, the existence of a motive to desire does not preclude the possibility of conflicting desires. The desire of avoiding an evil may master or control, but cannot extinguish a conflicting desire which urges man to a breach of duty. Hence it is no wonder, thatin spite of the most stringent sanctions, important duties and obligations are every day seen violated. But although the desire of avoiding a sanction can not directly extinguish a conflicting desire, it may do so gradually, or by association or habit.
