Following on from a consultation paper (Consultation paper 174; ISBN 0117302562) published in January 2004, this report contains proposals for reform of the law regarding the termination of a tenancy during its term, by a landlord, due to the tenant having broken the terms of the tenancy agreement. It sets out, in the form of a draft Bill, a new statutory scheme for the termination of tenancies, including a new concept of 'tenant default', to replace the current law of forfeiture. The proposed scheme would define the circumstances in which a landlord may seek to terminate a tenancy early, require the landlord to warn the tenant of the impending action by giving a written notice, and confers enhanced protection on those with interests deriving out of the tenancy. The report is divided into eight parts with three appendices, and issues considered include: problems with the current law of forfeiture of tenancies and the case for reform; the various components of the proposed scheme, including the concept of tenant default and the stages of a landlord's 'termination claim'; and the role of the court.

Mediation provides an attractive alternative to resolving disputes through court proceedings. Mediation promises just results in the interest of all parties concerned, a reduction of the court caseload, and cost savings for the parties involved as well as for the treasury. The European Directive on Mediation has given mediation in Europe new momentum by establishing a common framework for cross-border mediation. Beyond Europe, many states have tried in recent years to answer the question whether, and if so, how mediation should be regulated at a national and international level. The aim of this book is to promote the understanding and discussion of regulatory issues by presenting comparative research on mediation. It describes and analyses the law and practice of mediation in twenty-two countries. Reconstructing Marxism explores fundamental questions about the structure of Marxist theory and its prospects for the future. The authors maintain that the disintegration of the old theoretical unity of classical Marxism is in part responsible for what is commonly called the "crisis of Marxism." Only a reconstructed Marxism can come to terms with this disintegration. Addressing a range of problems in historical materialism and class analysis, the authors compare historical materialism with Darwinian evolutionary theory, and identify what is distinctively "historical" in Marx's theory of history. Through an evaluation of G.A. Cohen's defense and Anthony Giddens's critique of historical materialism they suggest what a plausible, yet still Marxist. theory of history might be. They analyze the relationship of microanalysis to macro theory and the assignment of causal primacy in explanations, and present a general assessment of the current state of Marxist theory and the prospects for its analytical reconstruction.
