Poynings' Law and the Making of Law in Ireland, 1660-1800
Author: James Kelly
Publisher:
ISBN:
Category : History
Languages : en
Pages : 432
Book Description
Poynings' Law (1494) was one of the most crucial statutes ever enacted by the Irish parliament, yet the law's crucial impact on parliament's operations from 1660 has never been examined systematically. James Kelly examines how Poynings' Law impacted on the legislative operations of the Irish parliament between the Restoration and the Act of Union, and he establishes how the Irish parliament contrived, first, by evolving a sophisticated heads of bills process in the late 17th century, second, by curtailing the power of the Irish privy council in the early 18th century, and finally, by securing the amendment of Poynings' Law in 1782, to achieve a degree of legislative independence that endured until the Act of Union. Based on a close and detailed scrutiny of the records of the Irish parliament and the systematic exploration for the first time of the voluminous records of the British privy council, this book provides a new, revealing perspective on the working of the Irish parliament, its relationship with the Irish executive and on the nature of the Anglo-Irish connection. Book Description
Excerpt from The Constitutional and Parliamentary History of Ireland Till the Union Irish Parliamentary and Constitutional history, speaking, as a political leader, not as an historical student. His statement, however, deals with facts and not with theories, and his description of the history, constitution, and powers of the Irish Parliament, in his speech at the Home Rule Conference in 1 873 is in remarkable accord with his description of the history, constitution, and powers of that Parliament, when speaking, not as an advocate of the restoration of Parliamentary institutions in Ireland, but as the leading Opponent of Mr. O'connell, in 1843, in the debate on Repeal of the Union in the Corporation of Dublin. I examined both speeches very carefully, and directed Mr. Butt's attention to their absolute agree ment in exposition of the history of the Irish Parliaments, which he acknowledged with gratification, stating that Mr. O'connell had said openly in the course of debate that Ireland would, in the future - Mr. Butt was then only in his thirtieth year - have in Mr. Butt a defender of Irish National rights, while he said to him in private that he would sooner or later be a great leader of the Irish Nation. Mr. Butt's outline of the history of the Irish Parliaments, which is unaffected by his political position in 1843 as an opponent of the Repeal of the Union, and in 1873 as an expounder of Home Rule, may be safely accepted as accurate and as an introduction to this work. National Constitutions in European and Global Governance: Democracy, Rights, the Rule of Law
Author: Anneli Albi
Publisher: Springer
ISBN: 9462652732
Category : Law
Languages : en
Pages : 1522
Book Description
This two-volume book, published open access, brings together leading scholars of constitutional law from twenty-nine European countries to revisit the role of national constitutions at a time when decision-making has increasingly shifted to the European and transnational level. It offers important insights into three areas. First, it explores how constitutions reflect the transfer of powers from domestic to European and global institutions. Secondly, it revisits substantive constitutional values, such as the protection of constitutional rights, the rule of law, democratic participation and constitutional review, along with constitutional court judgments that tackle the protection of these rights and values in the transnational context, e.g. with regard to the Data Retention Directive, the European Arrest Warrant, the ESM Treaty, and EU and IMF austerity measures. The responsiveness of the ECJ regarding the above rights and values, along with the standard of protection, is also assessed. Thirdly, challenges in the context of global governance in relation to judicial review, democratic control and accountability are examined. On a broader level, the contributors were also invited to reflect on what has increasingly been described as the erosion or ‘twilight’ of constitutionalism, or a shift to a thin version of the rule of law, democracy and judicial review in the context of Europeanisation and globalisation processes. The national reports are complemented by a separately published comparative study, which identifies a number of broader trends and challenges that are shared across several Member States and warrant wider discussion. The research for this publication and the comparative study were carried out within the framework of the ERC-funded project ‘The Role and Future of National Constitutions in European and Global Governance’. The book is aimed at scholars, researchers, judges and legal advisors working on the interface between national constitutional law and EU and transnational law. The extradition cases are also of interest to scholars and practitioners in the field of criminal law. Anneli Albi is Professor of European Law at the University of Kent, United Kingdom. Samo Bardutzky is Assistant Professor of Constitutional Law at the University of Ljubljana, Slovenia.
