This book presents a detailed analysis of Hawaii’s Opportunity Probation with Enforcement (HOPE) program. Developed by Judge Steven Alm in Hawaii in 2004, this model of ‘swift, certain and fair’ justice has been widely adopted across the United States. The book argues that although HOPE has principally been viewed in terms of its deterrent impact, it is in fact best understood through the lens of therapeutic jurisprudence and solution-focused courts, especially drug courts. Bartels presents a detailed overview of HOPE’s operation, as well as a critical assessment of the evaluation findings of HOPE and other programs based on this model. Crucially, the book draws on observational research to demonstrate that much of the commentary on HOPE has been based on misunderstandings about the program, and Bartels ultimately provides much-needed in-depth analysis of critiques of the HOPE model. A rigorous study which concludes by identifying key issues for jurisdictions considering implementing the model and areas for future research, this book will be of special interest to scholars of criminal justice, recidivism and drug-related issues.

Responding to family violence is a responsibility shared across government, the criminal justice system and the wider community. One part of the broader criminal justice response is the sentencing, and management under sentence, of family violence offenders. In March 2016, the Royal Commission into Family Violence recommended that the Sentencing Advisory Council ('the Council') examine one aspect of sentencing and managing family violence offenders, namely 'the desirability of and methods for accomodating "swift and certain justice" approaches to family violence offenders in Victoria's sentencing regime' (Recommendation 83). This book offers a critical appreciation of the nature and impact of coercive control in interpersonal relationships. It examines what this concept means, who is impacted by the behaviours it captures, and how academics, policymakers, and policy advocates have responded to the increasing recognition of the deleterious effects that coercive control has on especially women’s lives. The book discusses the historical emergence of this concept, who its main proponents have been, and how its effects have been understood. It considers the role of coercive control in making sense of women’s pathway into crime as well as their experiences of it as victims. Coercive control has been presented predominantly as a gendered process, and consideration is given in this book to the efficacy of this assumption as well as the extent to which the concept makes sense for a wide constituency of marginalized women. In recent years, much energy has been given to efforts to criminalize coercive control, and the concerns that these efforts generate are discussed in detail, alongside what the limitations to such initiatives might be. In conclusion, the book situates the rising pre-occupation with coercive control within the broader concerns with policy transfer, ways of taking account of victim-survivor voices, alongside the importance of working towards more holistic policy responses to violence(s) against women.
