This paper examines the sustainability claims of private quality standards, voluntary adopted by supermarket to improve the quality of products in respect of food safety, and environmental and social sustainability. The concept of lsquo;sustainability' is defined as the opportunity for upgrading by developing country suppliers in the retail supply chains. The paper reports of an explorative analysis on the perceived effects of 36 quality standards in the retail on upgrading. Data was collected through a survey of a wide variety of relevant media: websites, scientific articles and reports, policy reports, and online newspaper articles. The overall conclusion is that the majority of the 36 standards are perceived to facilitate trading opportunities for developing country producers, but only for those suppliers who can meet the criteria of quality standards. The study found interesting differences between various categories of standards. Standards initiated by NGOs and partnerships are perceived to offer better upgrading opportunities to suppliers than do standards initiated by (inter-) governmental authorities, by individual firms, or by business associations. Standards with an explicit social and social/environmental focus have a more positive influence on process and product upgrading in developing countries compared to voluntary food safety standards. Product-specific standards offer better upgrading opportunities than do generic quality standards.

This book provides a broad understanding of whether law plays a role in influencing patterns of sustainable consumption and, if so, how. Bringing together legal scholars from the Global South and the Global North, it examines these questions in the context of national, transnational and international law, within single and plural legal systems, and across a range of sector-specific issue areas. Since the turn of the Millennium, world-wide initiatives from the private sector have turned the regulatory environment for food businesses upside down. For the first time in legal literature this book analyses private law initiatives relating to the food chain, often referred to as private (voluntary) standards or schemes. Private standards are used to remedy flaws in legislation, in order to reach higher levels of consumer protection than the ones chosen by the EU legislature and to manage risks and liability beyond the traditional limits of food businesses. We see that litigation is no longer solely framed by legislative requirements, but ever more by private standards such as GlobalGAP, BRC, IFS, SQF and ISO. These private standards incorporate public law requirements thus embedding them in contractual relations and exporting them beyond the jurisdiction of public legislators. Other standards focus on corporate social responsibility or sustainability. This book also addresses how private religious standards such as Kosher and Halal play a role in defining specific markets of growing importance. It is noted that organic standards have found an interesting symbioses with public law. Another development on this topic is that food businesses are inspected more often by private auditors than by public inspectors. Effects in terms of receiving or being denied certification far outweigh public law sanctions. In short private law has changed an entire legal infrastructure for the food sector. It emerges as competing with the public law regulatory infrastructure. This book is of interest to all who concern themselves with food law legislation and litigation and the evolving role of private standards on changing the landscape of food chains and innovation.

This open access book focuses on the issue of sustainability standards from the perspective of both global governance frameworks and emerging economies. It stems from the recognition that the accelerated pace of economic globalization has generated production and consumption patterns that are generating sustainability concerns. Sustainability standards (and regulations) are increasingly being used in a bid to make global consumption and production more sustainable. Given the dense inter-connectedness of economic affairs globally, the use of sustainability standards has become a concern of global governance, who face the challenge of achieving a balance between the use of standards for genuine sustainability objectives, and not allowing them to turn into instruments of protectionism or coercion.The emerging economies, given their increasing engagement with the global economy, are most impacted by the use of sustainability standards. The emphasis of ‘emerging economies’ in this book is retained both by using case studies from these economies and by collating perceptions and assessments of those located in these economies. The case studies included span sectors such as palm oil, forestry, food quality, vehicular emissions and water standards, and address the problems unique to the emerging economies, including capacity building for compliance with standards, adapting international standards in domestic contexts and addressing the exclusion of small and medium enterprises etc. Complex interfaces and dynamics of a global nature are not limited to the thematic of this book but also extend to the process through which it was written.
