The purpose of this publication is to provide an update in terms of legislation, recent events, technology, to act as a more concise reference document on the duties of Local Authorities and others, and to update the best practice in terms of inspecting and securing Statutory Nuisance mine entrances.
Statutory Nuisance Mineshafts - Methods of Investigation and Duties of Local Authorities
Public Nuisance
Author: Linda S. Mullenix
Publisher: Cambridge University Press
ISBN: 1009334921
Category : Law
Languages : en
Pages : 287
Book Description
In Public Nuisance, Linda Mullenix describes the landscape of 21st century mass tort litigation involving public harms - including lead paint, opioids, firearms, e-cigarettes, climate change, and environmental pollution - and the novel theory of public nuisance that lawyers and local governments have used to receive compensation from those who have created public nuisances. The book surveys conflicting judicial decisions rooted in common law and statutory interpretation and evaluates the competing arguments for and against the expansion of public nuisance law. Mullenix argues that that the development of public nuisance theory is part of the historical arc of mass tort litigation and suggests a middle approach to new public nuisance law, namely that we should embrace the common law and legislated public nuisance statutes.

The right of access to open countryside
Author: Great Britain: Parliament: House of Commons: Committee of Public Accounts
Publisher: The Stationery Office
ISBN: 0215034570
Category : Science
Languages : en
Pages : 52
Book Description
The Countryside Rights of Way Act 2000 introduced a public right to walk across designated mountain, moor, heath, downs and registered common land in England. DEFRA tasked the Countryside Agency with opening-up the new access by the end of 2005, and the target was met with two months to spare. However the implementation of the right to roam cost the Countryside Agency £24.6 million more than anticipated, with knock-on impacts on other programmes. This report looks at the implementation of open access and the effect of the policy under the headings: encouraging the public to use the right to roam across the countryside; protecting the environment of access land and the rights of landowners; improving planning and project management. However the success of legislation is as yet unknown because there is no information on the extent to which the public are making use of their new right. In October 2006 the responsibility for open access passed from the Countryside Agency to Natural England.

Geological Hazards in the UK
Author: D.P. Giles
Publisher: Geological Society of London
ISBN: 1786204614
Category : Science
Languages : en
Pages : 499
Book Description
The UK is perhaps unique globally in that it presents the full spectrum of geological time, stratigraphy and associated lithologies within its boundaries. With this wide range of geological assemblages comes a wide range of geological hazards, whether they be geophysical (earthquakes, effects of volcanic eruptions, tsunami, landslides), geotechnical (collapsible, compressible, liquefiable, shearing, swelling and shrinking soils), geochemical (dissolution, radon and methane gas hazards) or georesource related (coal, chalk and other mineral extraction). An awareness of these hazards and the risks that they pose is a key requirement of the engineering geologist. The Geological Society considered that a Working Party Report would help to put the study and assessment of geohazards into the wider social context, helping the engineering geologist to better communicate the issues concerning geohazards in the UK to the client and the public. This volume sets out to define and explain these geohazards, to detail their detection, monitoring and management and to provide a basis for further research and understanding.

Compensation for Environmental Damages Under International Law
Author: Tarcísio Hardman Reis
Publisher: Kluwer Law International B.V.
ISBN: 9041134379
Category : Law
Languages : en
Pages : 250
Book Description
At present there is no clear model under international law with which to determine compensation for environmental damage. After showing that no existing standard of compensation defined by the theory and practice of international law is adequate to cover all cases involving environmental damages - and that such a broad standard or set of standards may in fact be ultimately unachievable - the author of this important book develops a 'fair compensation' regime from an analysis of existing international dispute adjudication mechanisms, and presents this model as the best possible current approach to the conciliation of international responsibility and environmental interests.

Law for Project Managers
Author: David Wright
Publisher: Routledge
ISBN: 1351663356
Category : Business & Economics
Languages : en
Pages : 184
Book Description
Law for Project Managers provides an easily understandable and practical guide to the laws of contract, liability, intellectual property and so on, entirely from the perspective of the project manager. It will enable you to approach projects forewarned and forearmed, able to avoid potential legal problems altogether. The book covers everything from intellectual property disputes with the client organisation about who actually 'owns' the outcome, to confusion arising during an international project from the different legal systems and their approach to contracts and health and safety problems in the management of contractors. Most importantly, it explains everything in very straightforward terms; legal jargon is either avoided altogether or defined with its relevance to the project manager explained. In essence, Law for Project Managers is a clear, readable and expert guide on this and many other important legal matters for the practising project manager as well as a supplementary text for post- or undergraduate students studying the commercial aspects of law, contracting and project management.
