Transparency of trade regulations by all WTO Members is essential for open, fair and predictable trade relations. A myriad of different regulations apply in all WTO Members and have the potential for affecting international trade. The Agreements on the Application of Sanitary and Phytosanitary measures and on Technical Barriers to Trade provide the most comprehensive frameworks in the WTO to address the costs arising from such regulatory diversity, through obligations on regulatory transparency and co-operation. This book gives a detailed account of the legal disciplines of the two Agreements, an in-depth presentation of discussions between WTO Members, and an overview of the few cases that end up in formal dispute settlement. It shows that the strength of the WTO legal and institutional system goes well beyond its dispute settlement system, with transparency enabling implementation of WTO obligations through better information sharing and co-operation among Members themselves, through non-judicial means.

Standards are a feature of virtually all areas of trade in products and services. Yet, although standards may achieve an efficient economic exchange, they have discriminatory consequences for trading partners when governments formulate or apply them in such a way as to cause obstacles to trade, thus enrolling standards among the increasingly significant ‘non-tariff barriers’ regulated by the WTO. This volume examines the complex relationship between economic and non-economic objectives in WTO law. It discusses how non-economic objectives (such as the protection of public morals, life and health, environment, or human rights) can serve as justification for trade-restrictive measures normally prohibited under WTO law. The relevant non-economic grounds of justification are analysed, as well as the substantive and procedural requirements which restrain the use of trade-restrictive measures taken for non-economic purposes. The issues covered by this book also have wider systemic implications for the WTO. Only if the WTO can demonstrate that it is not just concerned about free trade, but respects non-economic objectives as well, is it likely to remain a sustainable and legitimate form of governance.
