It is a form of public control over the use of private property in the interest of general welfare. Zoning may be defined as the creation of legal districts ulthin.which regulations prohibit injurious or unsuitable structures and uses of land and buildings. The use of this power directly by the state is the exception rather than the rule. Usually the power is delegated to local political subdivisions which may or may not make use of the authority as they see fit. This delegation is by an enabling act which is adopted by the legislature. They are not particularized. Moreover, as commonly conceived zoning cperates prospectively. It has as its object to prevent the recurrence of certain mistakes of the past; and it normally reaches only to preventing the future establishment of the designated misuse. Zoning is not a euro-all, and does not in itself constitute an entire land-use program; but it is rather one of several regulative measures which together might constitute such a program. In certain instances zoning may be desirably used as a center around which the complete program can be built. In other cases, zoning can be more appropriately used as a complement to other land-use measures. In still other cases, zoning may not be necessary at all, for either one or both of two reasons: either the circumstances do not warrant it, or other more feasible measures might accomplish under the circum stances all that zoning could accomplish. When, to what extent, and how the interest of the public in the use of lands is to be protected depends on what the circumstances call for. Bassett deals primarily with I the legal phases of zoning, in respect of both the require ments of the law of zoning and its practical application in the New York region. It does not contain any statement of policy regarding the classification of uses and the standards Of heights and densities of buildings. These physical aspects of the problem will be a subject for later consideration and treatment. Nor does it deal with the merits of zoning. The principle of zoning has been almost universally accepted as sound when proper methods are employed in its application. This application in a munici pality has to be by means of ordinances based on' a state enabling act. It is of essential importance that the powers conferred by the state enabling act should be adequate to permit of wise regulation of the uses of land and buildings and of the heights and densities of buildings to be constructed or reconstructed upon the land, and that the ordinances be framed in conformity _with the provisions of the enabling act. The purpose of the brochure is to provide helpful information as a guide for action, in the zoning of their areas, by municipal authorities in the New York region. Part I contains a series-of aids to the practice of zoning. In these aids Mr. Bassett has set forth what he conceives to be the leading considerations that should be borne in mind by municipal councils in giving effect to the powers conferred upon them by the state enabling act in New York, New Jersey, or Connecticut. Part II gives a description of the application of zoning in the City of New York.
