The United States is not meeting its obligations under the International Convention on the Elimination of All Forms of Racial Discrimination, a treaty the US ratified in 1994. This report, issued on the eve of international review of US compliance with the treaty, documents areas win which the US is falling short of its obligations. It focuses on areas that have been the subject of prior Human Rights Watch research, supplementing the analyses offered by other groups monitoring US performance under the treaty. Subjects detailed here include the failure of federal authorities to inform individual states of their obligations under the treaty, the discriminatory treatment of Haitian refugees by the US, and policies that have the effect of denying health care to many African-Americans with HIV/AIDS. In addition, the report presents new data collected by Human Rights Watch demonstrating that racial disparities in the sentencing of children to life in prison without possibility of parole are more pronounced than the US has acknowledged to date. In January 2016, a series of states of emergency for the City of Flint were declared by the Mayor, the Governor and even the President. These declarations turned the attention of the state and nation to the Flint water crisis. As a result, the state, local and federal governments sprang into action. The National Guard was tasked to assist. FEMA1 sent representatives. Community organizations and non-profits from throughout the state, and even nationally, responded by volunteering, and sending bottled water. The Governor formed Mission Flint, which brought key members of the Administration together weekly, and the Legislature authorized a supplemental budget. Bottled water and water filters were distributed and residents were provided information in multiple languages. It was all hands on deck. From all accounts, the government was operating the way we would expect it to operate in response to an emergency. What then, was the problem? The timing. Preceding this flurry of "state of emergency" activity, Flint residents had been reporting heavily discolored and bad tasting water for well over a year. This report is triggered by the Flint Water Crisis, but in many ways is not just about Flint. This report seeks to outline a broader framework to explain why the crisis occurred and to propose a set of recommendations that minimizes and safeguards against similar crises in the future. Our report is not meant to assess blame, but to help ensure that such a crisis does not occur in the future and to address shortcomings that continue to persist over time.

The International Convention on the Elimination of All Forms of Racial Discrimination was adopted thirty-five years ago, on 21 December 1965, by the General Assembly of the United Nations, and entered into force on 4 January 1969. It was the first of the universal human rights treaties with a treaty-monitoring body to be adopted and enter into force. At present, 156 States have ratified or acceded to this Convention. Under article 9 of the Convention, each State party has to submit a report within one year after the entry into force of the Convention for that State and thereafter every two years and whenever so requested. The Committee on the Elimination of Racial Discrimination has been formed to monitor the implementation of the Convention. At its fortieth session, in 1991, the Committee initiated the practice of adopting concluding observations by the Committee as a whole on each report it considered, and at its forty-third session, in 1993, the Committee started to use a standard format for the presentation of its concluding observations. The Committee makes a general evaluation of the report and of the dialogue with the delegation, and it makes note of positive developments that may have occurred during the period under review, of factors and difficulties impeding the implementation of the Convention, and of principal subjects of concern. It also makes suggestions and recommendations to the State party concerned. The present volume contains concluding observations adopted by the Committee on the Elimination of Racial Discrimination at its forty-third to fifty-seventh sessions (1993-2000).
