Esta monografía aborda el régimen jurídico de las sequías y situaciones de escasez hídrica desde una perspectiva integral y multinivel analizando detenidamente los instrumentos para su prevención y gestión. La investigación pone en valor la problemática actual del agua a la luz de los últimos y estudios sobre el cambio climático, abogando por una protección jurídica holística de este preciado recurso, bajo la óptica de los Derechos humanos. -- También se analiza exhaustivamente la organización administrativa y el marco competencial entorno a estos fenómenos, que, indudablemente, deben ser afrontados desde una perspectiva multinivel (Administración General del Estado, Administraciones autonómicas y Entes Locales). -- Asimismo, se precisan las funciones que desempeñan los Organismos de cuenca, la Dirección General del Agua, la Oficina Española del Cambio Climático, los Observatorios de Sequías y la Comisión Permanente para situaciones de adversidad climática o medioambiental, junto a otros organismos propuestos por el Proyecto de Orden por el que se elabora la Instrucción Técnica para la elaboración de los PES. A continuación, este estudio se centra en los instrumentos que brinda el Derecho de aguas. -- Se aborda la normativa y principios internacionales, con especial referencia a la Directiva Marco de Aguas. Se expone la evolución del Derecho estatal y su actual regulación, deteniéndonos en las obligaciones que instaura la Ley del Plan Hidrológico Nacional sobre la elaboración de los Planes Especiales de Sequía y los Planes de Emergencia, diferenciando ambas figuras, así como poniendo de relieve su vinculación y examinando su controvertida naturaleza jurídica, objetivos, estructura o contenido. Todo ello, completado con numerosos ejemplos prácticos de los planes vigentes y efectuando un análisis crítico sobre el grado de incumplimiento de los PEM. -- Igualmente, se valoran las precisiones sobre estos escenarios que contiene el Texto Refundido de la Ley de Aguas, el Reglamento del Dominio Público Hidráulico, el Reglamento de la Planificación Hidrológica, la Instrucción de Planificación Hidrológica y la reciente Ley de Cambio Climático y Transición Energética. Cierra este marco normativo la legislación de las Comunidades Autónomas que se han arrogado competencias sobre las cuencas intracomunitarias. Asimismo, esta obra se ocupa de otros títulos de intervención, dado que, la escasez hídrica ha de afrontarse, necesariamente, desde una perspectiva multisectorial (con medidas desde la protección civil, la planificación urbanística, el aseguramiento, la potenciación de recursos no convencionales, la fiscalidad, así como, desde el ámbito educativo, cultural e investigador). Finalmente, se estudia el instituto de la responsabilidad patrimonial en situaciones de sequía y escasez y se desarrolla una novedosa teoría en relación al incumplimiento de la obligación de elaboración de los Planes de Emergencia y la responsabilidad por inactividad administrativa.
