Since the early 1990s, Israel has enacted a managed migration scheme for low-skilled foreign workers. Originally designed to replace Palestinian cross-border workers from the Occupied Territories in the secondary labour market, in 2007 foreign workers comprised 8.7% of the private-sector labour force, 40% of them without permits. Foreign workers are employed in three major sectors: construction, agriculture and home-care for the elderly. The latter has become the largest and fastest-growing sector employing foreign workers, mainly women. The Israeli temporary labour migration scheme is characterised by a strong dependency of certain sectors on foreign workers; disengagement of governmental agencies from direct involvement in recruitment, inspection of work conditions, effective enforcement of labour laws, and provision of services for foreign workers; a strong emphasis on temporariness coupled with lengthy and sometimes indefinite extension of possible stay (up to 63 months and potentially more); and lastly, by an entrenched client politics that guides policies on quota setting, permit allocation and employer subsidies. Recent government decisions that seek to overcome the distorting effects of the scheme on the Israeli labour market, while tempering deep-rooted norms that violate workers' labour and human rights, are heading in the right direction. However, they are also destined to fail if the scheme is not substantially revised in all its parts rather than through a patchwork of focused and segmented measures.

"As part of Israel's acceptance into the OECD (Organization for Economic Co-operation and Development) in 2010, the OECD's Employment, Labour, and Social Affairs Committee published a review of Israel's labour market and social policies. The review contained 16 key recommendations for improvements in Israel's labour market and social policies in five broad areas: 1. The enhancement of employment opportunities for disadvantaged populations 2. Reducing gaps in education 3. The development of public infrastructures, such as transportation, in the periphery 4. The expansion and reform of pension coverage 5. The status of foreign workers in the labour market. Israel was asked to submit a progress report to the OECD on the implementation of the recommendations within two years of its joining. In 2012, the report was prepared under the auspices of the Minister of Economy with the assistance of the Myers-JDC-Brookdale Institute (MJB). In 2015 Israel was asked to prepare an additional report updating on the progress since 2012. Once again, the report was prepared with the assistance of the Institute. While the first report gave extensive detail on the issues and the various efforts to address the recommendations, the current report is shorter and focuses on the main changes that have since taken place"--

In Unsettled Labors, Rachel H. Brown explores the overlooked labor of migrant workers in Israel’s eldercare industry. Brown argues that live-in eldercare in Palestine/Israel, which is primarily done by migrant workers, is an often invisible area where settler colonialism is reproduced culturally, economically, and biologically. Situating Israeli labor markets within a longer history of imperialism and dispossession of Palestinian land, Brown positions migrant eldercare within the resulting tangle of Israeli laws, policies, and social discourses. She draws from interviews with caretakers, public statements, court documents, and first-hand fieldwork to uncover the inherently contradictory nature of elder care work: the intimate presence of South and Southeast Asian workers in the home unsettles the idea of the Israeli home as an exclusively Jewish space. By paying close attention to the comparative racialization of migrant workers, Palestinians, asylum seekers, and Mizrahi and Ashkenazi settlers, Brown raises important questions of labor, social reproduction, displacement, and citizenship told through the stories of collective care provided by migrant workers in a settler colonial state.

By exploring crimmigration at its intersection with international refugee law, this book exposes crimmigration as a system focused on the governance of territorially present migrants, which internalizes the impracticability of removal and replaces expulsion with domestic policing. The convergence of criminal law and immigration law, known as crimmigration, has become perhaps the paradigmatic model for governing migration in the age of globalization. This book offers a unique way of understanding crimmigration as a system of governmentality, the primary target of which is the population, its principal form of knowledge being political economy, and its essential mechanism being the apparatus of security. It does so by characterizing a particular model of crimmigration, termed ‘crimmigration under international protection’, which targets refugees and asylum-seekers who are principally undeportable under international law. The book draws on comparative research of such models implemented worldwide, combined with a detailed case study of the immigration detention system instigated in Israel for coping with asylum-seekers specifically and exclusively. These models demonstrate that, at its core, crimmigration is not a system of outright social exclusion focused on the expulsion of undesirable migrants, but rather one focused on the management, classification and policing of domestic populations. It is argued that under crimmigration regimes criminal law becomes instrumental in the facilitation of gradual assimilation, by shifting immigration enforcement from the margins of the state to the daily supervision of territorially present migrants. The book illustrates this point by focusing on three main themes: crimmigration as domestication; crimmigration as civic stratification and crimmigration as a mechanism coined by Foucault as the apparatus of security and by Deleuze as the society of control. By exploring these themes, the book offers a comprehensive framework for understanding the rise of crimmigration and the particular ways in which it targets resident migrants. The book will be of interest to researchers and academics working in the areas of criminal law and criminology, immigration law, citizenship studies, globalization studies, border studies and critical refugee studies.
