La incuestionable insuficiencia de los mecanismos jurídicos tradicionales de protección del medio ambiente para responder por sí mismos ante las nuevas amenazas e incertidumbres que caracterizan esta realidad, exige el desarrollo de acciones que permitan enfrentar los riesgos, buscando la protección del entorno natural. No es suficiente con la tarea de reparación de los daños ambientales ya ocurridos, sino que se hace necesario diseñar herramientas que permitan la anticipación y la evitación de dichos daños. De esta manera, los principios del derecho ambiental, primordialmente los de prevención y precaución, constituyen pilares fundamentales a la hora de hacer frente a los riesgos y peligros que pueden afectar la naturaleza. Esta perspectiva de evitación del daño resulta especialmente relevante para hacer realidad los objetivos de conservación de la naturaleza y de desarrollo sostenible en el marco de la protección del derecho al ambiente sano o adecuado. No parecería razonable atender las cuestiones ambientales sin poner de presente que cuando nos enfrentamos al reto de proteger la existencia de la vida en la tierra, la mejor manera de lograrlo es procurando que los daños ambientales jamás lleguen a generarse.
