The history Of the laws crea ting boards Of health in this city and throughout the state, and in other states and countries, if it were proper to delay the decision of this motion to demonstrate it, will show that extraordinary authority in reference to the general course of legal procedure, has been conferred on the persons charged with the duties of preserving the public health. It is proper that it should be so to prevent the spread of epi demies, and the fearful mortality which ensues, and is kin-3 dred to the power which is given to the mayor and others to destroy buildings, in case they deem them likely to take fire, or to convey fire to other buildings (2 Rev. Laws 1813, p. 300, 80) all resting upon the doctrine of necessity, which becomes imperious in its demands. The Board of Health may and should be regarded as the representatives Of the people of this city on the subject for which they were organized, to be aided in all respects in the lawful exercise of their authority, which looks to the high and noble duty Of preserving health and saving life. Excerpt from Practice Reports in the Supreme Court and Court of Appeals of the State of New York, 1875, Vol. 49 The device adopted by the defendants is, in all respects, like the plaintiff's device, except the monogram is F. G. In size, type, color and appearance, the two devices are entirely alike. The answer alleged that Julienne was a generic name, and the mixture of vegetable used in making julienne soup was prepared and imported into the United States long prior to its being put up and imported by the plaintiff, and was previously well known to the general public by the name of Julienne. Upon the pleadings and affidavits a motion was made and granted to dissolve the preliminary injunction, but no appeal was taken. On the trial the plaintiff testified that the article was put up for him in Paris, and that it had not before been prepared or put up in the same manner. There was evidence on the part of the defendants that the article known as Julienne was prepared and put up by several other manufacturers in France, and was imported into this country. One of the defendants testified that the defendants caused the label they used to be printed in Paris, by their agent, having previously seen the plaintiff's label on packages of the Julienne they had purchased from him.
