Nos encontramos en un momento en que Europa parece haber alcanzado un algo grado de unificación económica y se dirige hacia su unificación política, pues está ya discutiendo su Constitución. En este pequeño pero profundo libro, R.C. Caenegem estudia las razones históricas que se encuentran tras la diversidad jurídica de los diferentes países europeos, acentuando la importancia que en el continente tuvo la adopción del Derecho Romano estudiado en las universidades, que dio lugar al denominado Ius Commune, que fue, en su momento, un Derecho generalizado en los países de la Europa occidental. El libro estudia también la forma en que el nacimiento de los estados nacionales dio lugar a una multitud de códigos, nacionales también, aunque paradójicamente, con influencias recíprocas. El impacto de la política en el desarrollo del Derecho es otro factor clave y, como un ejemplo gráfico de ello,Van Caenegem estudia detalladamente la discusión que existió en los momentos anteriores a la promulgación del Código civil alemán entre romanistas y germanistas y el renacimiento de esta discusión en el pasado nazi de Alemania, que el autor examina también detalladamente. El libro concluye con un estudio del debate actual sobre la posibilidad y la conveniencia de una unificación jurídica europea y de una constitución federal para una Europa unida. R. D.Von Caenegem es profesor emérito en la Facultad de Derecho y en la Facultad de Letras de la Universidad de Gante. The public authorities have not successfully resolved the management of the traumatic memory of the wars, dictatorships and massacres to which the European project was always intended to be a counterpoint. The conflict of memories and the public discourses about the past are latent on ideological, political and cultural levels.
