Having previously examined the challenges of structuring a negotiation process that takes due account of pre-existing cultural and power differences between the parties, the author analyzes the significance of their choice of negotiation strategy on the negotiation process and outcome. In particular, this paper reflects on the promise and limitations of the parties' adopting interest-based, or “integrative”, negotiation strategies and the potential for fruitful entanglements between those strategies and indigenous diplomatic traditions.

Minority Accommodation through Territorial and Non-Territorial Autonomy explores the relationship between minority, territory, and autonomy, and how it informs our understanding of non-territorial autonomy (NTA) as a strategy for accommodating ethno-cultural diversity in modern societies. While territorial autonomy (TA) is defined by a claim to a certain territory, NTA does not assume that it is derived from any particular right to territory, allocated to groups that are dispersed among the majority while belonging to a certain self-identified notion of group identity. Colonialism may have significantly changed the history of North America, but its impact on Native Americans has been greatly misunderstood. In this book, Neal Ferris offers alternative explanations of colonial encounters that emphasize continuity as well as change affecting Native behaviors. He examines how communities from three aboriginal nations in what is now southwestern Ontario negotiated the changes that accompanied the arrival of Europeans and maintained a cultural continuity with their pasts that has been too often overlooked in conventional Òmaster narrativeÓ histories of contact. In reconsidering Native adaptation and resistance to colonial British rule, Ferris reviews five centuries of interaction that are usually read as a single event viewed through the lens of historical bias. He first examines patterns of traditional lifeway continuity among the Ojibwa, demonstrating their ability to maintain seasonal mobility up to the mid-nineteenth century and their adaptive response to its loss. He then looks at the experience of refugee Delawares, who settled among the Ojibwa as a missionary-sponsored community yet managed to maintain an identity distinct from missionary influences. And he shows how the archaeological history of the Six Nations Iroquois reflected patterns of negotiating emergent colonialism when they returned to the region in the 1780s, exploring how families managed tradition and the contemporary colonial world to develop innovative ways of revising and maintaining identity. The Archaeology of Native-Lived Colonialism convincingly utilizes historical archaeology to link the Native experience of the eighteenth and nineteenth centuries to the deeper history of sixteenth- and seventeenth-century interactions and with pre-European times. It shows how these Native communities succeeded in retaining cohesiveness through centuries of foreign influence and material innovations by maintaining ancient, adaptive social processes that both incorporated European ideas and reinforced historically understood notions of self and community.

Political theorists often imagine themselves as political architects, asking what an ideal set of laws or social structures might look like. Yet persistent injustices can endure for decades or even centuries despite such ideal theorizing. In circumstances of this kind, it is essential for political theorists to think carefully about the political choices available to those who directly face such injustices and seek to change them. This book focuses on the claims of Aboriginal peoples to better treatment from the United States and Canada. Though other groups face similarly persistent injustices (e.g. African Americans in the United States), the specific details of injustice matter a great deal for its analysis. The book focuses on two intertwined issues: the kinds of moral permissions that those facing persistent injustice have when they act politically, and the kinds of transformations that political action may bring about in those who undertake it. The book argues for normative permissions to speak untruth to power; to circumvent or nullify existing law; to give primary attention to protecting one's own community first; and to engage in political experimentation that reshapes future generations. When carefully used, the book argues, these permissions may help political actors to avoid co-optation and self-delusion. At the same time, divisions of labor between those who grapple most closely with state institutions and those who keep their distance may be necessary to facilitate escape from persistent injustice over the long term.
