Consumer out-of-court redress in the European Union is experiencing a significant transformation; indeed the current changes are the most important that have occurred in the history of the EU. This is due to the recent implementation of the Alternative Dispute Resolution (ADR) Directive 2013/11/EU and the Online Dispute Resolution (ODR) Regulation (EU) 2013/524. The Directive ensures the availability of quality ADR schemes and sets information obligations on businesses, and the Regulation enables the resolution of consumer disputes through a pan European ODR platform. The New Regulatory Framework for Consumer Dispute Resolution examines the impact of the new EU law in the field of consumer redress. Part I of the volume examines the new European legal framework and the main methods of consumer redress, including mediation, arbitration, and ombudsman schemes. Questo e-book tratta la disciplina del procedimento di mediazione per la conciliazione delle controversie civili e commerciali aventi per oggetto diritti disponibili introdotta dal decreto legislativo n. 28 del 2010, le cui norme di attuazione sono state dettate dal decreto del Ministro della giustizia n. 180 del 2010 (alcune di esse sono state modificate dai decreti del Ministero della giustizia n. 145 del 2011 e n. 139 del 2014), dopo la reintroduzione, da parte del decreto-legge n. 69 del 2013, convertito in legge n. 98 del 2013, della mediazione obbligatoria che la sentenza n. 272 del 2012 della Corte costituzionale aveva abrogato per eccesso di delega. Esso non si limita, però, alla sola esposizione dei contenuti delle norme di questi due testi normativi, il primo di natura legislativa e il secondo regolamentare, ma cerca di analizzare il più possibile i problemi interpretativi e pratici che esse pongono e le possibili soluzioni di questi. Grosso modo, possiamo dire che i primi sei paragrafi del testo sono dedicati all’esposizione dei contenuti del d.lgs. n. 28/2010, quindi all’analisi del procedimento di mediazione, mentre i paragrafi da 7 a 11 trattano maggiormente le disposizioni del d.m. 180/2010, quindi la disciplina delle spese della mediazione, quella degli organismi di mediazione e quella degli enti di formazione per i mediatori. The recent development of ideas on biodiversity conservation was already being considered almost three-quarters of a century ago for crop plants and the wild species related to them, by the Russian geneticist N.!. Vavilov. He was undoubtedly the first scientist to understand the impor tance for humankind of conserving for utilization the genetic diversity of our ancient crop plants and their wild relatives from their centres of diversity. His collections showed various traits of adaptation to environ mental extremes and biotypes of crop diseases and pests which were unknown to most plant breeders in the first quarter of the twentieth cen tury. Later, in the 1940s-1960s scientists began to realize that the pool of genetic diversity known to Vavilov and his colleagues was beginning to disappear. Through the replacement of the old, primitive and highly diverse land races by uniform modem varieties created by plant breed ers, the crop gene pool was being eroded. The genetic diversity of wild species was equally being threatened by human activities: over-exploita tion, habitat destruction or fragmentation, competition resulting from the introduction of alien species or varieties, changes and intensification of land use, environmental pollution and possible climate change.
