Le produit cosmétique est quasiment aussi ancien que l'homme. Au fil des années, les matières premières deviennent de plus en plus modernes et performantes. Les progrès constants réalisés par l'industrie cosmétique et le rôle croissant de l'apparence physique dans notre société, ont fait évoluer la cosmétique esthétique vers une cosmétique scientifique, évolutive, corrective et traitante. Des zones d'ombre apparaissent entre la définition du produit cosmétique et celle du médicament, rendant la frontière entre l'esthétique et la thérapeutique floue. Malgré une procédure de mise sur le marché, un contrôle de la publicité et un système de vigilance propre à chacun des deux statuts, des produits dits "frontières" ont fait leur apparition accompagnés d'un vide juridique. Les exemples étrangers de création d'une catégorie de produits intermédiaires entre médicament et produit cosmétique n'ont, pour le moment, pas été suivis en Europe. Les nouveaux règlements européens tels que le règlement cosmétique ou encore le règlement REACH visent à éviter les divergences d'interprétations nationales et encadrent de façon plus stricte le produit cosmétique. Cependant, se pose la question de légiférer à nouveau et d'élaborer un cadre juridique spécifique aux produits frontières ou simplement de sensibiliser les professionnels face cette problématique.

Cependant, bien que les définitions du produit cosmétique et du médicament s'excluent mutuellement, une étude plus approfondie révèle des lacunes, notamment de part des définitions larges et une interprétation extensive du médicament, posant le problème de la qualification des produits "frontières", non définis par le droit et dont le nombre ne cesse de s'accroître en raison de l'évolution de la cosmétique esthétique vers une cosmétologie active, peuvent en théorie relever des deux régimes juridiques et sont donc à l'origine d'une jurisprudence. De plus, cette frontière délicate à tracer est accentuée par la possibilité pour les produits cosmétiques de revendiquer des allégations "bénéfiques pour la santé". Celles-ci, autorisées mais soumises à un contrôle des autorités en France peuvent entraîner une difficulté de catégorisation des terminologies et une certaine confusion chez le consommateur. Il s'avère donc nécessaire, afin de garantir la protection de la santé publique, de rechercher des moyens de préciser une nouvelle délimitation de ces produits "frontières" en leur conférant, notamment, un système juridique propre à l'instar des réglementations américaine, australienne et japonaise.
