Il est généralement admis qu'elle se manifeste lors d'un rapport juridique entre au moins deux individus, lorsque l'un des deux fait des représentations ou assurances créant ainsi dans l'esprit du bénéficiaire une attente légitime sur une situation déterminée. Cependant, elle requiert la réunion d'autres éléments qui permettent de la distinguer du simple espoir. Néanmoins, malgré son importance, à ce jour, la notion d'attentes légitimes n'a pas fait l'objet d'une définition précise. Cette thèse vise à combler cette lacune en identifiant ses éléments constitutifs. Les attentes légitimes sont entendues de deux manières : d'une part, comme les attentes fondamentales qui naissent entre un individu et un État ; d'autre part, comme les attentes qui naissent d'un rapport interétatique. S'agissant d'un sujet qui n'a pas encore été étudié de manière approfondie, il est également nécessaire d'analyser sa relation avec d'autres principes et notions du droit international économique, notamment le standard du traitement juste et équitable et le principe de bonne foi, mais également d'examiner les mécanismes visant à limiter sa portée.

In international investment law, the prism of indirect expropriation includes a broad range of measures – such as regulatory measures – which do not involve a transfer of property but result in a serious interference with an investment. The definition of compensable taking is a very sensitive issue situated at the crossroads between the protection of investors' private rights and the safeguarding of the state's sovereign prerogatives. This book explores, through the example of environmental regulation, the law applicable to this controversial topic. It suggests that the traditional approach – based on an extension of the concept of expropriation – is inappropriate and it contributes to clarifying the scope of the international protection of the investor on the ground of the law of state responsibility.

This book explores the interaction between the EU and international investment law, both at the internal level, namely within the EU internal market, and at the external level, i.e. in the context of its relations with third States. The joint treatment of these dimensions reveals that the EU has assumed an ostensibly ambivalent attitude towards international investment law. At the internal level, it has consistently asserted that intra-EU international investment agreements (IIAs) are not compatible with EU law and advocated their termination. At the external level, by contrast, it has eagerly deployed IIAs to develop its post-Lisbon international investment policy. The book finds that beneath this apparent ambivalence towards international investment law ultimately lies the EU's attempt to impose, both internally and externally, its own original model of regulation of cross-border investment. It then argues that the EU adopted this approach with a view to supporting its internal market, enhancing its external influence, and, ultimately, pursuing long-term 'federal aspirations'. Finally, the book identifies the legal and political obstacles that have curtailed the EU's efforts at both the internal and the external level.
