Excerpt from Legal and Judicial History of New York In 1842 it was resolved to curtail the power of the legislature to incur debt. This decision and the reaction against the tendency to involve the government in private business led to the convention of 1846. The work of that convention and the constitution reported by it, the third constitution of the State, have been discussed in this book. Whatever may be the common impression, the most important part of the labor of that convention dealt with the subject of public debts. The next succeeding constitutional convention was that of 1867, all of whose work except the judiciary article was rejected at the polls. Then followed the constitutional commission of 1872, which took up a large part of the unaccepted effort of the convention of 1867, revised it, and presented it to the State legislatures in such form that much of it was eventually incorporated in the constitution. To the able and thoughtful men in the convention of 1867 it must have seemed lamentable that their labors were not appreciated. The valuable ideas which the convention formulated first passed through the crucible of public discussion and afterwards were debated in the commission of 1872. The good work of the convention was not lost; on the contrary it was improved, and fortunately for the people, some notions much in vogue at the time were never submitted by the legislature for popular vote, and were happily kept out of the organic law. The lesson which that period should teach is that proposed constitutional changes need thorough consideration before their submission to the people. Excerpt from History of the Court of Common Pleas of the City and County of New York: With Full Reports of All Important Proceedings During 1895 the writer contributed a number of articles to the New York press. One of these entitled End of the Common Pleas, was published in the Sun of May roth. This book is the sequence of that article. It is not a law treatise. The decisions of no Court have been better reported than those Of the Court of Common Pleas of the City and County of New York. It treats of the personal side of the Court, and is in a measure, therefore, supplementary to the Reports. The writer may have erred in dealing so little with the many interesting trials, decisions and questions of law which have arisen and have been adjudicated during the life of this Court. He has been frequently tempted also to include such stories and anecdotes as have come within his knowledge, and they have been many, but has refrained because he wished rather to produce a work which should be dignified and in keeping with the spirit of one of the Oldest, if not the oldest, Court our people have known. The Minutes are gone into at some length, because the proceedings covered by them are historical, and for the reason that this part of the history of the Court has nowhere else been printed. Sketches of all, and portraits of twenty-one of the twenty-three Judges identified with the later history of the Court, will be found within these covers. There are also portraits of many whose names appear in the text. Without the peculiar experiences incident to the collecting Of biographical data, there can be no conception of the amount of labor involved. The simple note in the appendix concerning Judge Inglis gives little or no idea of the amount of time and inquiry devoted to obtaining the material for his sketch, and yet scarce half a century has passed since he sat on the bench. Excerpt from Statutory Law of New York Regarding the Insane All sales, etc, made in good faith by such committee, in pursuance of such orders, shall be valid and effectual as if made by such lunatic when of sound mind. The disposition of the proceeds of the property sold, etc., shall be made according to the order of the court, so as to secure the same for the benefit of such lunatic; and shall require accounts to be rendered periodically by any committee or other person who may be intrusted with the income of such proceeds. No sale, made in the manner provided, shall have the effect of givmg the lunatic any other or greater interest or estate in the proceeds of the sale than he had in the estate sold, but the proceeds shall be deemed real estate of the same nature as the property sold. Acceptance of a gross sum may be granted in lieu of dower when a dower interest is the subject of sale, where the person entitled thereto shall consent in writing, or may direct the se curing of a reasonable annuity in lieu of dower. But before any such sum shall be paid, or such annuity secured, the court shall be satisfied that an effectual release of such right 'of dower has been executed.
