Outre le questionnement portant sur l'accès au marché de ces entreprises et d'une éventuelle différence entre la position du Conseil de la concurrence et celle du Conseil d'Etat, la question de l'ampleur de l'assimilation des services publics aux entreprises classiques constitue donc un point particulièrement problématique.
