Institution nouvelle de la V° République, le Conseil Constitutionnel assure, parmi ses fonctions, le contrôle de conformité de la loi au Bloc de Constitutionnalité, ensemble de normes de références. En fait, cette cour constitutionnelle française, aux caractères spécifiques, dispose effectivement de larges pouvoirs quant à la délimitation des normes de référence, utilise des méthodes de contrôle raffinées, et a une influence importante sur tout l'édifice juridique. Mais elle n'est qu'un témoin de l'État de Droit où chaque autorité doit s'exercer sous le contrôle de juges. La loi n'exprime la volonté générale que dans le respect de la Constitution.
