Land Use Law for Sustainable Development
Author: Nathalie J. Chalifour
Publisher: Cambridge University Press
ISBN: 1139460587
Category : Law
Languages : en
Pages : 606
Book Description
This 2007 book surveys the global experience to date in implementing land-use policies that move us further along the sustainable development continuum. The international community has long recognized the need to ensure ongoing and future development is conducted sustainably. While high-level commitments towards sustainable development such as those included in the Rio and Johannesburg Declarations are politically important, they are irrelevant if they are not translated into reality on the ground. This book includes chapters that discuss the challenges of implementing sustainable land-use policies in different regions of the world, revealing problems that are common to all jurisdictions and highlighting others that are unique to particular regions. It also includes chapters documenting new approaches to sustainable land use, such as reforms to property rights regimes and environmental laws. Other chapters offer comparisons of approaches in different jurisdictions that can present insights which might not be apparent from a single-jurisdiction analysis.

People, Place and Property Rights
Author: Ulrika Kolben Waaranperä
Publisher: Routledge
ISBN: 1000468879
Category : Law
Languages : en
Pages : 142
Book Description
For more than a century, property rights to land in Molo in the Kenyan highlands have been subjected to diverse reforms and desires. Colonial and independent state administrations have restructured land tenure systems to establish and maintain authority or alleviate landlessness. Meanwhile, people on the ground have developed their own ideas about property rights, place, and people. Via a detailed political ethnography, Ulrika Kolben Waaranperä uncovers the heterodox notion of property rights that has emerged as land has been redistributed, settlement schemes established, electricity lines drawn, and electoral violence mobilized. The book makes an important contribution to the study of land and politics in Kenya and beyond by drawing attention to how conceptions of property rights are shaped by and constitutive of relations of belonging and authority. This relational view challenges the universal definition of property rights undergirding most contemporary land reforms. Instead, property rights are situated within the political and rendered legible for both definitional and distributional debates. In effect, land reform is posited as a fundamentally political undertaking.

Book Description
"Land tenure is a sensitive issue in Africa and a central theme in the demand for political and economic reform in the region. While traditional development strategies aim for maximum economic growth, new approaches emphasize conservation. The governing of land use is also central to the overall scheme of national governance - the constitution. This book examines the relationship between land ownership and the conservation of natural resources, using the case of Kenya. It proposes specific measures for achieving a balance between private ownership and public interest, and between conservation and economic growth"--Publisher's description.
