La Constitución, entendida como un mecanismo de precompromiso colectivo (como un conjunto de reglas de difícil reforma que disciplinan el ejercicio del poder político para la salvaguarda de los derechos básicos individuales), parece exigir que el juez constitucional recurra a las intenciones del constituyente para interpretarla. La versión más estricta del originalismo es la que vincula significado e intención del hablante. Esta tesis semántica del emisor puede ser concebida también bajo los parámetros del realismo semántico, pero esta posibilidad nos compromete con el objetivismo metaético.
