La incapacidad temporal tiene un desarrollo normativo preferentemente vinculado a su condición de prestación de Seguridad Social, y es esa perspectiva la que ha sido objeto de una mayor atención normativa y judicial. Ese mayor interés por la vertiente de Seguridad Social ha derivado en la ausencia de una regulación adecuada en materia laboral, y con ello se generan incertidumbres que es necesario abordar, pues se echan en falta criterios que proporcionen seguridad jurídica en aspectos básicos como el plazo de reincorporación al trabajo, los límites al control empresarial, la compatibilidad con otras actividades o el ejercicio de determinadas facultades empresariales durante la suspensión del contrato por IT, incluida la potestad disciplinaria. Ese análisis pone de manifiesto que la incapacidad temporal despliega efectos muy diversos sobre el contrato de trabajo, lo que la convierte en una causa de suspensión de la relación laboral sui generis, y que, en último término, parece imprescindible una regulación específica que aporte seguridad jurídica y una adecuada coordinación entre la normativa laboral y la de Seguridad Social. En tanto el legislador actúa, el presente estudio sugiere múltiples opciones interpretativas para tratar de conciliar los distintos intereses en juego, y principalmente los del trabajador y el empresario vinculados a la buena marcha de la relación laboral, que está llamada a continuar a la finalización del proceso de IT.
