The workshop referred closely to the results of a first workshop held in Bangkok in 2002 (The International Workshop on Factors Contributing to Unsustainability and Overexploitation in Fisheries) but aimed more specifically at answering the following three major questions: What are the major obstacles to the implementation of major legal instruments? What are the main lessons learned and the possible paths to solutions for improved implementation? What are the possible gaps that may exist in these instruments to guide the international community in improving the management of marine fisheries? The workshop was based on a review of eleven case studies, each relating to one of the following categories of fishery: large volume small pelagics; tuna and tuna-like species; large volume demersals; and coastal fisheries. This publication contains the report of the Workshop, discussion papers containing case studies and notes submitted by participants. The document, and in particular the conclusions adopted by workshop participants, will serve as a basis for further analytical work aimed at improved fisheries management and a more effective implementation of major international fisheries instruments.

The concept of a fishing entity is a new category of fishing actors, separate from that of states, in the international law of the sea. The emergence of this new category provides a significant development towards a more flexible application of regulations regarding usage of the sea. A fishing entity owns advanced technology and fishing skills, and, as such, has an important role to play in global and regional conservation and management of fishery resources. Despite this, it is defined as being distinct from a state in the relevant legal documents, resulting in unclear circumstances involving certain global and regional agreements which usually apply to the latter. This ambiguity is particularly prevalent in legal procedures on the high seas when the sovereignty of a state comes into question, such as boarding and inspection. Thirty-one regional fishery bodies (RFBs) participated in the Eighth Meeting of the Regional Fishery Body Secretariats’ Network (RSN-8). The meeting brought together RFBs with diverse mandates from all geographic regions, including FAO and non-FAO regional fishery bodies, marine and inland fishery advisory and management bodies, the UNDOALOS and other invited organizations. The meeting allowed participants to exchange views and discuss both global fisheries management and development issues in aquaculture, as these related to regional and global processes of particular relevance to RFBs. In addition, RSN-8 provided the opportunity to discuss the development and strengthening of the RSN, as well as a space for reflection on the outcomes of COFI 34 and their implications for regional fishery bodies. The meeting had a high level of participation, which underlined the role of the network as a unique forum in which to foster cooperation, facilitate discussion and share experiences.

Responsible fisheries management is of increasing interest to the scientific community, resource managers, policy makers, stakeholders and the general public. Focusing solely on managing one species of fish stock at a time has become less of a viable option in addressing the problem. Incorporating more holistic considerations into fisheries management by addressing the trade-offs among the range of issues involved, such as ecological principles, legal mandates and the interests of stakeholders, will hopefully challenge and shift the perception that doing ecosystem-based fisheries management is unfeasible. Demonstrating that EBFM is in fact feasible will have widespread impact, both in US and international waters. Using case studies, underlying philosophies and analytical approaches, this book brings together a range of interdisciplinary topics surrounding EBFM and considers these simultaneously, with an aim to provide tools for successful implementation and to further the debate on EBFM, ultimately hoping to foster enhanced living marine resource management.
