Aquí se aborda el problema de los derechos humanos en contextos multiculturales. Se trata de lograr un diálogo intercultural en torno a tan importantes derechos, para lograr acuerdos y cumplirlos lo mejor posible. Para ello, el autor aplica la hermenéutica, que se ha probado como un instrumento útil en el ámbito del multiculturalismo, para lograr una situación de interculturalidad. Concretamente, el autor propone una hermenéutica analógica, que evite un enfoque univocista, en el que la cultura hegemónica se imponga a las más débiles; evita también un abordaje equivocista, en el que las diversas culturas interactúan sin llegar a un consenso que asegure cierta universalidad. En cambio, con un enfoque analógico (la analogía es proporción) se respetarán dentro de lo posible las diferencias entre las culturas en juego, como porciones que se ordenan, procurando alcanzar el consenso necesario para los derechos humanos cuya vocación es la universalidad.

The modern state, law, and constitution result from a legal canon that (re)produces the abyssal lines dividing the world that is validated from the world whose humanity and epistemological validity are denied. This book aims to contribute to a post-abyssal reflection on law and constitutionalism by considering the structural axes of power that are constitutive of modern law “capitalism, colonialism, and heteropatriarchy” alongside the legal plurality of the world. Entender la construcción dialógica de la universalidad de los derechos humanos como una necesidad ética y social de envergadura nos conduce a reformular nuestra concepción de la ciudadanía. Esta se ejerce básicamente en los espacios de deliberación pública, lamentablemente hoy colonizados por el logocentrismo, la lengua y la cultura hegemónica. Descolonizar dichos espacios para hacerlos inclusivos de la diversidad es una tarea pendiente. Para ello son necesarias las "políticas interculturales de reconocimiento", siempre y cuando se articulen a políticas redistributivas y de representación política tanto afirmativas como transformativas. En ello consiste el interculturalismo como posibilidad.

This book addresses a growing area of concern for scholars and development practitioners: discriminatory gender norms in legally plural settings. In Neoliberalism from Below—first published in Argentina in 2014—Verónica Gago examines how Latin American neoliberalism is propelled not just from above by international finance, corporations, and government, but also by the activities of migrant workers, vendors, sweatshop workers, and other marginalized groups. Using the massive illegal market La Salada in Buenos Aires as a point of departure, Gago shows how alternative economic practices, such as the sale of counterfeit goods produced in illegal textile factories, resist neoliberalism while simultaneously succumbing to its models of exploitative labor and production. Gago demonstrates how La Salada's economic dynamics mirror those found throughout urban Latin America. In so doing, she provides a new theory of neoliberalism and a nuanced view of the tense mix of calculation and freedom, obedience and resistance, individualism and community, and legality and illegality that fuels the increasingly powerful popular economies of the global South's large cities.
