The draft Local Transport Bill consists of a package of measures intended to promote stronger joint working between local authorities and bus operators, to support the introduction of local road pricing schemes and to enable changes to be made to local transport governance. This report follows the structure of the draft Bill. Although the remarks are related to specific clauses some of the recommendations have a more general application. Included with the report is consideration of the Transport Innovation Fund, which is closely linked to congestion and the draft Bill. The Committee is however unhappy that at the end of their inquiry the Secretary of State announced further consultation on parts of the Bill related to the powers and status of the traffic commissioners on reform of the Bus Service Operators' Grant and transitional arrangements for quality contract schemes.

Although road accident deaths have halved between 1958 and 2007 whilst the number of licensed motor vehicles and vehicle mileage covered increased by 400 per cent, the current rate of 3,000 deaths and 250,000 injuries is still an unacceptably high level. Road accidents are the largest single cause of death for people between the ages of 5 and 35 in Britain, and road accidents cost our economy some £18 billion each year. The number of deaths and injuries on roads far outweighs the deaths and injuries in other transport modes, and should be viewed as a major public health problem. The Government should establish a British Road Safety Survey to track overall casualty and safety trends, and review current methods for recording road-traffic injuries. The Committee recommends a systems approach to road safety: ensuring the vehicle, the road infrastructure, regulations and driver training are designed to similar safety and performance standards. Other recommendations include: more 20 mph speed limits; a more proactive approach to determining the safety benefits of new vehicle technologies; action on young drivers - who represent a disproportionate risk to road users - and vulnerable users: motorcyclists, elderly and child pedestrians and cyclists, horse riders; a higher priority given to enforcement of drink-drive and drug-drive offences. The Committee recommends the establishment of an independent Road Safety Commission with powers to work across the whole of government, ensuring that a high priority and adequate resources are given to road safety and that all government departments and agencies give active support. The Government should also establish a road accident investigation branch, like those in aviation, rail and marine.

And yet the role of government lawyers in Australia, and specifically the Solicitor-General as the most senior of government lawyers, is under-theorised and under-studied. The Role of the Solicitor-General: Negotiating Law, Politics and the Public Interest goes behind the scenes of government – drawing from interviews with over 45 government and judicial officials – to uncover the history, theory and practice of the Australian Solicitor-General. The analysis reveals a role that is of fundamental constitutional importance to ensuring both the legality and the integrity of government action, thus contributing to the achievement of rule-of-law ideals. The Solicitor-General also works to defend government action and prosecute government policies in the court, and thus performs an important role as messenger between the political and judicial branches of government. But the Solicitor-General's position, as both an internal integrity check on government and an external warrior for government, gives rise to competing pressures: between the law, politics and the public interest. The Committee remains to be convinced that incentive or charging schemes will work well in England. The operation of only five pilot schemes (out of a total of 354 local authorities) by 2012, covering four different collection methods, in a mixture of rural and urban settings, is unlikely to provide sufficient information to judge whether all authorities should be able to offer such collection schemes. The Committee cannot see why any council would set up a complicated incentive or charging scheme that earns it no money and risks widespread public disapproval. The pilot schemes will have government funding, but that will not be available should there be a roll-out across all authorities, and the Committee calls for a full assessment of the implications for council budgets of instigating such schemes. No scheme will start before 2009, but will run for three years, which means that financial incentive schemes will have no discernible effect on local authorities' duty to meet European Union landfill diversion targets before penalties fall due in 2010 and 2013. The government's decision to cap the amounts local authorities can offer as incentives or take in charges runs counter to its rhetoric on local decision making. The Committee believes the government has retreated from its proposals outlined in the "Waste strategy for England 2007" (Cm. 7086, ISBN 9780101708623). The result is a messy compromise attracting hostile media coverage for a limited set of pilot schemes that will have little impact before EU fines fall due. The government should reconsider devolving the power to introduce schemes to local authorities themselves, as they are best placed to judge how refuse should be collected and whether local residents should be asked to gain incentives by increasing their recycling or to pay additional charges if they do not.
