Book Description
The Employment Standards Act of British Columbia sets minimum standards for terms of employment and working conditions in most workplaces that fall under provincial legislative jurisdiction. This consultation paper is issued in connection with the British Columbia Law Institute's Employment Standards Act Reform Project, which is the first comprehensive, independent review of the Act to be carried out in more than 25 years. The consultation paper reviews the Act and advances tentative recommendations for its reform. The tentative recommendations are intended in part to address transformative change in the workplace brought about by digitalization, the growth of precarious work, and demands from employers and workers alike for greater “flexibility” in working arrangements. They also address issues relating to the enforcement of the Act. The consultation paper has been issued to seek public comment on the tentative recommendations, which is requested by 31 August 2018. A subsequent report will contain final recommendations on reform of the Act.

Book Description
The nature of employment is changing: low wage jobs are increasingly common, fewer workers belong to unions, and workplaces are being transformed through the growth of contracting-out, franchising, and extended supply chains. Closing the Enforcement Gap offers a comprehensive analysis of the enforcement of employment standards in Ontario. Adopting mixed methods, this work includes qualitative research involving in-depth interviews with workers, community advocates, and enforcement officials; extensive archival research excavating decades of ministerial records; and analysis of a previously untapped source of administrative data collected by Ontario’s Ministry of Labour. The authors reveal and trace the roots of a deepening "enforcement gap" that pervades nearly all aspects of the regime, demonstrating that the province’s Employment Standards Act (ESA) fails too many workers who rely on the floor of minimum conditions it was devised to provide. Arguably, there is nothing inevitable about the enforcement gap in Ontario or for that matter elsewhere. Through contributions from leading employment standards enforcement scholars in the US, the UK, and Australia, as well as Quebec, Closing the Enforcement Gap surveys innovative enforcement models that are emerging in a variety of jurisdictions and sets out a bold vision for strengthening employment standards enforcement. Book Description
Across the United States, increasing numbers of employers are breaking, bending, or evading long-established laws and standards designed to protect workers, from the minimum wage to job safety standards to the right to organize. This "gloves-off economy," no longer confined to a marginal set of sweatshops and fly-by-night small businesses, is sending shock waves into every corner of the low-wage labor market. In the process, employers who play by the rules are under growing pressure to follow suit, intensifying the search for low-cost business strategies across a wide range of industries and ratcheting up into ever higher reaches of the labor market. Although other books have touched on pieces of this problem, The Gloves-off Economy is the first to provide a comprehensive, integrated analysis--and quite a disturbing one. This book examines a range of gloves-off practices, the workers who are affected by them, and strategies for enforcing workplace standards. The editors, four respected labor scholars, have brought together economists, sociologists, labor attorneys, union strategists, and other experts to offer varying perspectives on both the problem and the creative solutions currently being explored in a wide range of communities and industries. Annette Bernhardt, Heather Boushey, Laura Dresser, and Chris Tilly and the volume's other authors combine rigorous analysis with a stirring call to renew worker protections in the twenty-first century.

Book Description
"Do core labour standards exist in today's global economy? If so, what are they? And most important how effective are they?" "In this book two labour law scholars answer these questions in a definitive manner. In detail they demonstrate that, although insufficiently legally binding instruments governing employment and labour exist beyond the national level, a significant body of international soft law has developed that does in fact carry great weight. Blanpain and Colucci identity four major sources of this soft law - the UN Global Compact of 1999, the ILO Tripartite Declaration of Principles, the North American Agreement on Labour Cooperation and the OECD Guidelines for Multinational Enterprises - and show how the principles these instruments enunciate act as a countervailing power to the international economic decision-making of multinational corporations." "The authors cite relevant cases and highlight emerging trends in this important area of labour law. Annexes reprint all four of the instruments. The Globalization of Labour Standards will be welcomed by all sectors of the labour and employment law community as a fully realized analysis of what is currently available to those who would like to ensure economic and social progress in a world dominated by multinational corporations."--BOOK JACKET.
