En la actualidad el terrorismo se ha convertido en un problema global que cada vez afecta a más países y se cobra un mayor número de víctimas. Prueba de ello es la elevada cifra de atentados extremadamente sangrientos que se han perpetrado en todo el mundo contra la población civil desde principios del presente siglo. De entre ellos, pueden destacarse como ejemplo por su especial gravedad los acaecidos en Casa Blanca, Nueva York, Bali, Madrid, Londres, París o Bruselas. Es evidente que hoy en día ningún Estado u organización internacional puede permanecer ajeno a este problema, que ha pasado a ser considerado como uno de los principales riesgos contra la paz y seguridad en las sociedades contemporáneas. Ante la creciente demanda social de una mayor capacidad preventiva por parte de los poderes públicos en materia de ataques terroristas, parece necesaria la incorporación de nuevas estrategias y métodos que permitan aumentar la efectividad de los estados en su persecución. No obstante, el encaje de tales medidas debe producirse siempre desde la óptica del respeto a los derechos fundamentales, pues estos últimos constituyen la base jurídico-política de nuestro sistema de justicia penal, única capaz de restringir legítimamente la libertad del individuo.
