La deriva punitiva que viene caracterizando la evolución de nuestra legislación penal en las últimas décadas, y de la que es significativo exponente la reciente introducción de la «prisión permanente revisable», es a menudo justificada por el poder político de turno apelando a la «demanda o voluntad ciudadana». Sin embargo, más allá de genéricas apelaciones a la «voz ciudadana», que parecen así meras coartadas para imponer concepciones ideológicas predeterminadas, en nuestro país apenas se han realizado esfuerzos para hallar y (menos) comprender lo que demandan los ciudadanos de la justicia penal y el castigo. Por otra parte, realizar, como en el mejor de los casos se hace, una mera encuesta telefónica a ciudadanos desinformados sobre sus preferencias punitivas, no nos lleva a conocer más que su «opinión desinformada», o mejor dicho, el primer «impulso» ciudadano sobre la cuestión. El objetivo del presente libro es, primero, avanzar en la superación de este estadio tan precario de opinión ciudadana, pasando de un «impulso público» («opinión desinformada») a un «juicio reflexivo u opinión informada». Para ello se recurre a la metodología de la Encuesta Deliberativa diseñada por James Fishkin, cuyo objetivo fundamental es posibilitar una opinión ciudadana basada en la deliberación y el debate informado. En segundo lugar, el libro también pretende demostrar que el mito de una ciudadanía punitiva, al que con frecuencia apelan nuestros políticos para justificar sus reformas punitivas, es una construcción política y mediática que silencia otra realidad, igualmente presente, y que emerge en cuanto las condiciones en las que florecen los discursos punitivos (carencia de información y debate, preeminencia de emociones como la ira o el miedo), son modificadas por otras que permiten germinar visiones diferentes del castigo (información, reflexión, debate y evocación de emociones ligadas con la empatía, la solidaridad y la compasión). En tercer lugar, objetivo último del libro es contribuir al debate sobre la construcción de un Derecho penal (más) democrático, razonando por qué hemos de atender a la voz ciudadana en el diseño de la política criminal, y demostrando que no se ha de temer que dicha voz nos lleve a un «peor» Derecho penal, sino más bien a uno más legítimo a la par que humano.
