The need to regulate access to genetic resources and ensure a fair and equitable sharing of any resulting benefits was at the core of the development of the Convention on Biological Diversity (CBD). Trata-se de um trabalho realizado por docentes, pesquisadores, operadores jurídicos e alunos, todos com um objetivo comum - trazer à elaboração desta pesquisa pontos inovadores a respeito do que há de mais recente no Direito Socioambiental. Optou-se pela utilização da expressão Direito socioambiental como um ramo do direito que não tem a pretensão de instaurar uma nova disciplina jurídica, mas com a intenção de unir em uma única abordagem indissociável as espécies de meio ambiente consagradas pela Constituição Federal de 1988, quais sejam o meio ambiente natural, meio ambiente cultural, meio ambiente urbano e meio ambiente do trabalho. Isto deve-se ao fato de que o meio ambiente constitui um conjunto complexo, harmônico e interdependente de todas as formas de vida, esta relação não afasta a interação que as formas de vida exercem no meio em que vivem, logo resumir a regulamentação jurídica em direito ambiental é proporcionar, em parte, a exclusão de discussões necessárias e primordiais para entender a relação existente no meio ambiente. Esta pesquisa é resultado de debates realizados na Pontifícia Universidade Católica do Paraná, em especial no Grupo de Pesquisa de Direitos socioambientais, que pretende, através da reunião permanente de docentes, pesquisadores, acadêmicos e interessados proporcionar análises interdisciplinares construtivas à proteção do meio ambiente.
