Concepts of Normativity: Kant or Hegel?
Author:
Publisher: BRILL
ISBN: 9004409718
Category : Philosophy
Languages : en
Pages : 270
Book Description
The influence of Kant’s understanding of morality is too strong to be ignored. Hegel, however, fundamentally criticized Kant for offering merely a ‘formal’ model of normativity that cannot sufficiently comprehend human action as free. Instead, Hegel argues in his doctrine of ethical life (Sittlichkeit) that the embeddedness of the acting subject must be taken into account when identifying normativity. Yet the issue of normativity in Kant and Hegel remains contested even today, not least due to the misunderstandings of their conceptions of the topic. The present volume explores developments within recent scholarship which enable a better understanding of the concept of normativity in the thought of Kant and Hegel.

Fichte and Kant on Freedom, Rights, and Law
Author: Gunnar Beck
Publisher: Lexington Books
ISBN: 9780739122945
Category : Law
Languages : en
Pages : 264
Book Description
Contrary to received scholarship, Beck concludes that Kant's theory of rights, like Fichte's, contains an unsettling message for many incompletely reasoned contemporary liberal theories of rights, which rarely discuss those additional ontological, epistemological, and psychological foundations on which the defense of liberal individualistic rights ultimately rests. Fichte and Kant on Freedom, Rights, and Law is an essential book for scholars of these two philosophers."--BOOK JACKET.

Kant im Streit der Fakultäten
Author: Volker Gerhardt
Publisher: Walter de Gruyter
ISBN: 3110182777
Category : Philosophy
Languages : de
Pages : 324
Book Description
The last work published by Kant himself is a study of the relationship of philosophy to other academic disciplines. The very title of the work, Streit der Fakultäten (Dispute between the Faculties), published in 1797, makes it clear that the various disciplines are related critically, even polemically, to each other. As academic disciplines they share common obligations of knowledge, enlightenment and education; in their relationship with each other, however, they have the duty to contest the means and aims of knowledge. There can only be living science where this dispute about knowledge is conducted with the means of knowledge. In this volume, representatives of the faculties addressed by Kant give their assessment of Kant's relevance for their disciplines. As the Dispute between the Faculties was and is of importance for the foundation of the University of Berlin, Kant's contribution to university reform is also considered.

Kant und seine Kritiker – Kant and His Critics
Author: Antonino Falduto
Publisher: Georg Olms Verlag
ISBN: 3487157322
Category : Philosophy
Languages : de
Pages : 423
Book Description
There are still significant gaps in the study of the historical and systematic contexts of Kant’s philosophy. This is true even more of our understanding of the significance of the objections and criticisms levelled at Kant’s philosophy and of the development of his philosophy and its reception and depiction in later centuries. The essays in this volume seek to close these gaps. They are based on the papers given at the 7th multilateral Kant Colloquium with the theme “Kant und seine Kritiker – Kant and his critics – Kant et ses critiques” which took place from 28th-30th April 2017 at the Martin-Luther-University, Halle-Wittenberg.

Cassirer in Contexts
Author: Andrzej Karalus
Publisher: Felix Meiner Verlag
ISBN: 3787343741
Category : Philosophy
Languages : en
Pages : 213
Book Description

The Constitutionalization of International Law
Author: Jan Klabbers
Publisher: OUP Oxford
ISBN: 0191615919
Category : Law
Languages : en
Pages : 414
Book Description
The book examines one of the most debated issues in current international law: to what extent the international legal system has constitutional features comparable to what we find in national law. This question has become increasingly relevant in a time of globalization, where new international institutions and courts are established to address international issues. Constitutionalization beyond the nation state has for many years been discussed in relation to the European Union. This book asks whether we now see constitutionalization taking place also at the global level. The book investigates what should be characterized as constitutional features of the current international order, in what way the challenges differ from those at the national level and what could be a proper interaction between different international arrangements as well as between the international and national constitutional level. Finally, it sketches the outlines of what a constitutionalized world order could and should imply. The book is a critical appraisal of constitutionalist ideas and of their critique. It argues that the reconstruction of the current evolution of international law as a process of constitutionalization -against a background of, and partly in competition with, the verticalization of substantive law and the deformalization and fragmentation of international law- has some explanatory power, permits new insights and allows for new arguments. The book thus identifies constitutional trends and challenges in establishing international organisational structures, and designs procedures for standard-setting, implementation and judicial functions. This paperback edition features the authors' discussion of this book on the EJIL Talks blog.
