The chapters in this volume are based on the papers that were presented at the Calcutta seminar organized in March 1992 by the ILA Committee on Lehal Aspects of a New International Economic Order (NIEO). The conference focused on the right to development, in particular its ideas and ideology, human rights aspects and implementation in specific areas of international law. The volume is accordingly organized in three parts. The chapters cover a vast area of subjects, derived from the UN Declaration of the Right to Development. Professor Oscar Schachter observes in the first chapter that the Declaration continues to be a `challenging subject for legal commentary' for its `detable legal status, its combination of collective and individual rights, its expansive conception of development and its equivocal obligation'. Human rights advocacy in the West is changing. Before the turn of the century, access to goods such as food, housing, and health care—while essential to human survival—were deemed outside of the human rights sphere. Traditional human rights institutions focused on rights in the political arena that could be defended through legal systems. In Freedom from Poverty, Daniel P. L. Chong examines how today's nongovernmental organizations are modifying human rights practices and reshaping the political landscape by taking up the cause of subsistence rights. This book outlines how three types of NGOs—human rights, social justice, and humanitarian organizations—are breaking down barriers by incorporating access to economic and social goods into national laws and advancing subsistence rights through nonjuridical means. These NGOs are using rights not only as legal instruments but as moral and rhetorical implements to build social movements, shape political culture, and guide development work. Rights language is now invoked in churches, political campaigns, rock concerts, and organizational mission statements. The question of the universality and relativity of human rights and the relationships between human rights, humanitarian law and refugee protection are the subject of theoretical debates that concern international lawyers, academics, and international organizations. But, most importantly, it should be stressed that these debates are among people who are trying to understand ways of constructing strategies for dealing with the fundamental issue: helping people who are victims of abuse. This volume, which has emerged from a colloquium organised by the Graduate Institute of International Studies and its Program for the Study of International Organization(s), attempts to project an integrated approach for helping those who are in need and to discuss ways of guaranteeing greater protection of certain universal values that underlie such help. It is the result of ideas shared between the major three organizations in this field, the UN Center for Human Rights, The International Committee of the Red Cross, and the United Nations High Commissioner for Refugees, and outside experts on the relationship between the different protection regimes.
