The degree of development reached by cooperatives of different sectors throughout the world, which among others led to the UN declaring 2012 as the International Year of Cooperatives, needs to be accompanied by a similar development of corresponding legislation. To this end, a better knowledge of cooperative law from the comparative point of view, as has already been established for other types of enterprises, becomes of great importance. This book strives to fill this gap, and is divided into four parts. The first part offers an analytic and conceptual framework with which to understand, study and assess cooperative law from a transnational and comparative perspective. The second part includes several chapters dealing with attempts to harmonize cooperative laws. The third part contains an overview of more than 30 national cooperative laws, while the last part summarizes and compares these national cooperative laws, thus laying the foundation for a comparative cooperative law doctrine.

La cooperativa es un modelo de empresa democrática y participativa que desde sus raíces en la primera mitad del siglo XIX se ha distinguido por la adecuación de sus acciones a unos principios de funcionamiento que, junto con los valores a los que aspira, conforman su identidad. La identidad es justamente el conjunto de rasgos que identifican a esta cooperativa y la diferencian del resto de empresas que llevan a cabo la actividad económica en una sociedad. La identidad cooperativa la forman en la actualidad los valores y principios cooperativos aprobados por la Alianza Cooperativa Internacional en el Congreso Centenario de la misma institución, que tuvo lugar en Manchester en 1995. Esta identidad pone a las cooperativas en dirección a la sostenibilidad económica, social y medioambiental. Alejandro Martínez Charterina es catedrático de la Universidad de Deusto y Director del Instituto de Estudios Cooperativos de la Facultad de Derecho. Es miembro del Equipo de Investigación de Cooperativismo, Fiscalidad y Derecho Social, reconocido por el Gobierno Vasco, así como del Grupo de Investigación Internacional en Derecho Cooperativo de la Asociación Internacional de Derecho Cooperativo. Cuenta con múltiples publicaciones en materia de economía social y particularmente de cooperativismo.
