Council asked for additional input from the Judges Technology Advisory Committee. Based on a review of jurisprudence established by the Supreme Court of Canada, JTAC has concluded that the right of the public to open courts is an important constitutional rule, that the right of an individual to privacy is a fundamental value, and that the right to open courts generally outweighs the right to privacy. This discussion paper further develops the many policy and logistical issues which arise when courts accomodate electronic filing and electronic retrieval of court records and docket information.
