En effet, soucieux de réaffirmer et de consolider leurs souverainetés fraîchement acquises les Etats africains ont exercé une influence remarquable sur le droit international général écrit. En outre, les Etats africains, fort d’un projet de commun de société et d’une coopération accrue, ont développé un droit international spécifiquement africain assurant ainsi l’inculturation du droit international général et opérant subtilement, par moment et par endroit, une dissidence normative par rapport au droit international général encore dominé par les grandes puissances. Le Code de droit international africain rend compte de cette tension, mieux de cette symbiose, entre le général et le particulier. Il est subdivisé en deux parties. La première présente les principaux textes de droit international général qui s’est incontestablement enrichi ces cinquante dernières années de l’apport ou de l’influence des pays en voie de développement. La deuxième partie quant à elle, reflète de l’effort d’inculturation et d’appropriation des règles générales et du souci constant de répondre aux besoins spécifiques de l’Afrique, présente les principaux textes de droit international africain. Le présent Code se veut un outil aux mains des étudiants, chercheurs et professeurs de droit international dans l’espoir qu’il leur permettra d’imprimer à leurs enseignements et travaux scientifiques une touche africaine ou africaniste en vue d’une vision complète du droit international.
