Book Description
Excerpt from Capital Punishment, Based on Professor Mittermaier's Todesstrafe A Treatise from Professor Mittermaier's pen on any topic connected with the theory or practice of the law, is worthy of perusal by the profession; but there is no subject on which he is more entitled to be heard, than the one discussed in the following pages. The events of every day show, that this is a topic of interest not only to lawyers, but to the public at large. For a long series of years Professor Mittermaier has devoted a large portion of his time and abilities to the investigation of this most important question. He is no mere theoretical opponent to Capital Punishment, and the advocates for the maintenance of the penalty will find in him a fair though powerful antagonist. In order to adapt the work to the requirements of the English reader, it appeared necessary to make a few alterations. Accordingly in Chapters I. and II. fuller details regarding the history of the subject, and the writers on it, have been given. Besides, a concluding chapter has been added, in which the question has been considered in its special bearing on the actual state of England. Book Description
Increasingly, international governmental networks and organisations make it necessary to master the legal principles of other jurisdictions. Since the advent of international criminal tribunals this need has fully reached criminal law. A large part of their work is based on comparative research. The legal systems which contribute most to this systemic discussion are common law and civil law, sometimes called continental law. So far this dialogue appears to have been dominated by the former. While there are many reasons for this, one stands out very clearly: Language. English has become the lingua franca of international legal research. The present book addresses this issue. Thomas Vormbaum is one of the foremost German legal historians and the book's original has become a cornerstone of research into the history of German criminal law beyond doctrinal expositions; it allows a look at the system’s genesis, its ideological, political and cultural roots. In the field of comparative research, it is of the utmost importance to have an understanding of the law’s provenance, in other words its historical DNA.

Book Description
The history of criminal justice in modern Germany has become a vibrant field of research, as demonstrated in this volume. Following an introductory survey, the twelve chapters examine major topics in the history of crime and criminal justice from Imperial Germany, through the Weimar and Nazi eras, to the early postwar years. These topics include case studies of criminal trials, the development of juvenile justice, and the efforts to reform the penal code, criminal procedure, and the prison system. The collection also reveals that the history of criminal justice has much to contribute to other areas of historical inquiry: it explores the changing relationship of criminal justice to psychiatry and social welfare, analyzes representations of crime and criminal justice in the media and literature, and uses the lens of criminal justice to illuminate German social history, gender history, and the history of sexuality.

Book Description
This book aims to investigate the life and work of Paul Koschaker (1879-1951), who was one of the most prominent legal historians during the first half of the 20th century. From the 1930s onwards, Koschaker is renowned for having attempted reaffirm the authority of Roman law, which was experiencing a major crisis at German universities at the time, mainly due to the Nazi regime's disdain for this subject. Above all, he intend to emphasise the role Roman law played as a cornerstone of European legal tradition, as was masterfully depicted in his book 'Europa und das romische Recht'. Moreover, Koschaker had many other areas of interest throughout his career, such as cuneiform laws and comparative legal history issues. This work in particular attempts to provide the first comprehensive study of Koschaker's biographical experiences, as well as his scientific and academic stances, which have come to light as a result of the discovery and analysis of numerous previously unpublished archival sources.
