Book Description
Bioprospecting--the search for useful biochemical compounds and genes in nature--has been the focus of international negotiations for more than a decade. This book examines the optimal property rights structures and institutional mechanisms for regulating bioprospecting for drug research. It includes examples of bioprospecting collaborations in several countries.

Book Description
Biodiversity research and prospecting are long-standing activities taking place in a new legal and ethical environment. Following entry into force of the Convention on Biological Diversity in 1993, and other recent policy developments, expectations and obligations for research and prospecting partnerships have changed. However, to date there are few guides to integrating these concepts with practice. This book offers practical guidance on how to arrive at equitable biodiversity research and prospecting partnerships. Drawing on experience and lessons learned from around the world, it provides case studies, analysis and recommendations in a range of areas that together form a new framework for creating equity in these partnerships. They include researcher codes of ethics, institutional policies, community research agreements, the design of more effective commercial partnerships and biodiversity prospecting contracts, the drafting and implementation of national 'access and benefit-sharing' laws, and institutional tools for the distribution of financial benefits. As part of the People and Plants initiative to enhance the role of communities in efforts to conserve biodiversity and use natural resources sustainably, Biodiversity and Traditional Knowledge will be invaluable to students, researchers and local communities, academic institutions, international agencies, government bodies and companies involved in biodiversity research, prospecting and conservation.

Book Description
Contracts relating to scientific/technical development are effective only where they are enforceable or valid under relevant law, can be practically implemented by the parties, and address matters arising from the relevant scientific/technical issues and practices. Negotiators are often hampered by their lack of knowledge of contract law and of the biotechnological techniques used to derive new molecules and genes or genetic or biochemical formulas from biological samples. This lack of knowledge means they may not make the best choices. This book examines the special issues in applying contract law to the rights to take and utilize genetic resources; and the scientific issues and the manner in which they affect the negotiation of ABS agreements.

Book Description
Despite the growing interest in biodiversity as a source of valuable new products and biochemical information, there have been very few systematic efforts to estimate the value of preserving biological resources for this purpose. Drugs of Natural Origin gives you a detailed model of the value of wild biological resources for pharmaceutical research and development. Author Anthony Artuso presents several decision models and analytical techniques that you can use to assess the economics of biochemical prospecting efforts whether you’re part of a private corporation, nonprofit research institute, developing country government, or international organization. Drugs of Natural Origin explores the policy options available to developing countries and international organizations to tap into the emerging market for biological resources in such a way as to provide both incentives for conservation of biodiversity and new opportunities for economic development. You’ll find evaluations of a range of proactive strategies that can be used to protect and enhance developing countries’biological resources. In addition, you’ll learn about a bioeconomic model that incorporates the potential biochemical and genetic value of a diverse ecosystem into land use planning and development. Developing country and international policymakers will find Drugs of Natural Origin a useful tool for determining how best to conserve biodiversity, while sustainably developing biological resources. This book outlines a comprehensive and integrated set of policy measures, research and development initiatives, and financing arrangements that could increase biochemical research activity while providing incentives for conservation of biodiversity and a potential path for sustainable development. Managers of pharmaceutical R&D programs will use the decision models developed in Drugs of Natural Origin to plan, evaluate, and continually refine their R&D programs. The book’s theoretic framework provides you with an analytical tool for systematically evaluating critical decisions at each stage of the R&D process. Thus, you learn to incorporate both subjective assessments and quantitative data into a comprehensive framework for R&D decisionmaking.

Book Description
The production of medicines - pharmaceutical and herbal - involves the sourcing of both genetic resources in the natural environment, as well as local knowledge. Sourcing substances for medicines in the natural environment is known as biodiversity prospecting or 'bioprospecting.' To ensure that the benefits resulting from medicinal bioprospecting are brought to those ultimately bearing the costs of conservation and sustainable use, there must be a focus on indigenous peoples' rights, particularly property rights - whether this is applied to the actual land, to genetic material, to intellectual property, or to traditional medicinal knowledge. This study, which is an outcome of doctoral research at the European University Institute, considers the importance of access and benefit-sharing agreements as incentives for biodiversity protection. It analyzes the meaning of the objectives set by the Convention on Biological Diversity for its implementation. It also examines selected domestic access and benefit-sharing measures and industry practices, and it evaluates the discussions taking place in international fora regarding the Convention and its principles. Finally, the book makes recommendations on how to realize the objective of the Convention for 'fair and equitable' benefit-sharing, focusing on enhanced protection of indigenous peoples' rights.
