Airport sponsors who receive a grant from the Federal Aviation Administration for an airport project are obligated to agree to a number of assurances. One of those assurances provides that the airport sponsor will make the airport available for public use on reasonable conditions and without undue discrimination. The intent of this assurance is to ensure that aeronautical users will have reasonable access to the airport. Airport sponsors can encounter issues under this grant assurance by limiting access to the airport, directly or indirectly, ranging from adopting express restrictions on particular aeronautical activities to less obvious actions to ensure safety, security, and economic sustainability, such as enforcing airport rules and regulations and negotiating and enforcing lease and rental agreements, airport fees, and local laws. This digest describes the sponsor assurances and how they limit the airport sponsor from unreasonably restricting access for aeronautical activity at general aviation airports. The report concludes by reviewing the major legal issues of concern in achieving airport-compatible land use.
