Countries which take spatial planning seriously should take planning law and property rights also seriously. There is an unavoidable logical relationship between planning, law, and property rights. However, planning by law and property rights is so familiar and taken for granted that we do not think about the theory behind it. As a result, we do not think abstractly about its strengths and weaknesses, about what can be achieved with it and what not, how it can be improved, how it could be complemented. Such reflections are essential to cope with current and future challenges to spatial planning. This book makes the (often implicit) theory behind planning by law and property rights explicit and relates it to those challenges. It starts by setting out what is understood by planning by law and property rights, and investigates - theoretically and by game simulation - the relationships between planning law and property rights. It then places planning law and property rights within their institutional setting at three different scales: when a country undergoes enormous social and political change, when there is fundamental political debate about the power of the state within a country, and when a country changes its legislation in response to European policy. Not only changing institutions, but also global environmental change, pose huge challenges for spatial planning. The book discusses how planning by law and property rights can respond to those challenges: by adaptive planning), by adaptable property rights, and by public policies at the appropriate geographical level. Planning by law and property rights can fix a local regime of property rights which turns out to be inappropriate but difficult to change. It questions whether such regimes can be changed and whether planning agencies can make such undesirable lock-ins less likely by reducing market uncertainty and, if so, by what means.

This book is about the ways in which two western European countries attempt to cope with the changing demands of urban development. In particular, it is con cerned with the differences in approach of the Dutch and English planning systems and the contrasting ways in which they are used to guide, promote and control development. The book results from a research study in which members of staff at Delft of Technology and Oxford Polytechnic compared local planning and University development in the Netherlands and England. The aim was to investigate ways in which development was promoted and controlled under different planning systems. The research was subsequently developed along two converging lines. One was an examination of over twenty case studies of plan making and the con trol of development in the cities of Leiden and Oxford. The other was a study of the two planning systems and the ways in which the respective approaches to planning were seen to relate closely to the contrasting legal and administrative systems and differences in development practice. The convergence of the two lines of enquiry produced a tension between empirical observations and theoretical supposition which led to a fruitful development of ideas about the nature of the two planning systems and how they promote and control develop ment.

The Netherlands is one of the most prominent and innovative countries in the field of environmental planning. Over the past decade, its government has introduced such ground-breaking schemes as Integrated Environmental Zoning, the City-Environment Project, the Bubble Concept and Policy Concepts and new approaches to coping with noise, odours, soil pollution, air pollution and safety issues. These initiatives and policy tools reflect a rapidly changing and decentralising environmental policy, which contrasts with more conventional environmental ideologies. However, at present little is known of these policies in the international arena. De Roo shows how and why, in recent years, the country's planning system has moved away from its traditional 'top-down' structure. The resulting changes have had far-reaching consequences for the traditional principles of Dutch environmental policy. In addition, measures for compensating excessive environmental loads are now open to discussion and environmental quality is a subject of negotiation among stakeholders. All these developments mean that environmental policy-making has become more closely integrated with local initiatives that focus on general location-specific qualities.
