This book analyses the legal framework for refugee protection in Africa, including both refugee and human rights law as well as treaty and institutional elements. The regime is addressed in two parts. Part One analyses the relevant treaties: the 1951 Convention relating to the Status of Refugees, the 1969 Organization of African Unity Convention Governing the Specific Aspects of Refugee Problems in Africa and the 1981 African Charter on Human and Peoples Rights. The latter two regional instruments are examined in depth. This includes the first fulsome account of the African Refugee Conventions drafting, an interpretation of its unique refugee definition and original analysis of the relationships between the three treaties. Significant attention is devoted to the systemic relationship between the international and the regional refugee treaties and to the discrete relationships of conflict and complementary relationships between the two refugee instruments, as well as to the relationships between the African Refugee Convention and African Charter. Part Two focuses on the institutional architecture supporting the treaty framework. The Organization of African Unity is addressed in a historical sense, and the contemporary roles of the African Union, the African Commission on Human and Peoples Rights and the current and contemplated African human rights courts are examined. This book is the first devoted to the legal framework for refugee protection in Africa.

Based on the work of Ahmed Karadawi, Refugee Policy in Sudan discusses Sudanese government policy towards the refugee flows from Ethiopia into the Eastern Region of Sudan in theperiod 1967 to 1984, arguing that there were two underlying assumptions behind successive governments' policies: that refugees were considered a security threat and a socio-economic burden. In response,the policies incorporated the Organization of African Unity norms, which offered a platform to depoliticise the refugees, equally with the international conventions relating to refugees, which assured the externalization of responsibility and access to aid. This prescription, however, ignored the dynamism of the conflict that continued to generate refugees - and, as numbers accumulated in Sudan, the international aid regime did not act as a willing partner of the government. The consequences of a sizeable refugee population revealed a serious conflict of priorities, not only within the Sudanese government of the day, but also between the government and aid donors - thus, the objectives of the government policy were seriously undermined.

In this study of Hutu refugees from Burundi, driven into exile in Tanzania after their 1972 insurrection against the dominant Tutsi was brutally quashed, Liisa Malkki shows how experiences of dispossession and violence are remembered and turned into narratives, and how this process helps to construct identities such as "Hutu" and "Tutsi." Through extensive fieldwork in two refugee communities, Malkki finds that the refugees' current circumstances significantly influence these constructions. Those living in organized camps created an elaborate "mythico-history" of the Hutu people, which gave significance to exile, and envisioned a collective return to the homeland of Burundi. Other refugees, who had assimilated in a more urban setting, crafted identities in response to the practical circumstances of their day to day lives. Malkki reveals how such things as national identity, historical consciousness, and the social imagination of "enemies" get constructed in the process of everyday life. The book closes with an epilogue looking at the recent violence between Hutu and Tutsi in Rwanda and Burundi, and showing how the movement of large refugee populations across national borders has shaped patterns of violence in the region.
