L'absence de réglementation commerciale multilatérale relative à la protection des droits des travailleurs suscite néanmoins une création normative de la part des acteurs étatiques et non étatiques. Ainsi, dans un cadre conventionnel (les accords commerciaux bilatéraux comme les accords commerciaux régionaux) ou unilatéral (le système de préférences généralisées) certains États lient leurs relations commerciales au respect de normes de travail. Par ailleurs, l'on observe l'émergence de normes privées à l'initiative d'entreprises (les codes de conduite) ou d'organisations non gouvernementales (les initiatives relatives au commerce équitable) relatives à la protection de certains droits des travailleurs. L'échec de la proposition d'insérer une « clause sociale » dans les Accords de l'Organisation Mondiale du Commerce lors de la création de cette institution internationale en 1994 et la diversité des contenus de ces « clauses sociales » ont conduit à l'adoption, lors des Conférences internationales du Travail de 1998 et de 2008, de deux instruments normatifs promotionnels rappelant aux États les principes et droits fondamentaux au travail à respecter. Le respect de ce socle de droits universels apparaît lié à l'intervention de l'État et à la coopération avec l'Organisation Internationale du Travail. La mise en oeuvre des diverses « clauses sociales » est liée à l'existence de mécanismes juridiques contraignants ou incitatifs de même qu'au rôle des acteurs étatiques et non étatiques. L'enjeu est bien que le nouvel ordre économique international assure la protection des droits fondamentaux des travailleurs.

Regional trade agreements have expanded exponentially over the past decade, and have become a significant, if controversial, factor in the expanse of economic globalization. Social Regionalism in the Global Economy attempts to take a fresh, interdisciplinary approach to addressing labour regulation by drawing upon insights from industrial relations, comparative capitalism, and new governance schools of thought. It stands for the proposition that an interdisciplinary study of regional regulation holds the potential to offer a fuller account of social regionalism. Its focus is to consider how institutions and labour market actors reconstruct and renegotiate regulatory space in a changing economic environment characterized by regional impulses. It argues that there is a dynamic interplay between institutions and actors of social regulation. This interplay occurs at many levels. The book therefore maps both how actors shape institutions as well as how institutions shape social actors’ ability to affect regulatory processes. The editors bring together leading international specialists willing to move beyond textual analyses of regional agreements to offer alternative accounts of regional integration.
