The partiality of the Courts of Law to submitting building cases to reference, rather than deciding them in open court, has created much difficulty in obtaining established precedents from recorded cases and the tendency of the new measure will be rather to increase than to diminish this difficulty. Under these circumstances, we have done our best to direct aright those who may have given less attention to the subject than ourselves; and we hope at some future time, when the measure shall have been perma uently wrought into working shape, to present a still more complete edition to the public.
