The decisions of the Judges are not mere dry statements of rules and principles. The student will there meet with a well-balanced weighing of facts, a just criticism of arguments, a luminous exposition of law, and occasionally farsighted and lofty considerations of expediency, joining for the moment the domain of the legislator with the province of the judge. And there is this further advantage, last but not least in the eyes of the practical lawyer, that through the study of these Reports a man becomes familiar with the tone of thought, the attitude of mind, which prevail in our Courts, he gets a touch of the genius of English law, the Author would venture to add - of the mind of the English race. Excerpt from Selected Cases on the Law of Contracts The arrangement of topics follows that of Sir William Anson in his Principles of the English Law of Contracts, whose general plan has served as a model for some other treatises on the subject. This case book, however, covers some topics not dealt with in his book; and some that are treated there are not included here. Two chap ters appearing in the former editions of this book, namely, Capacity of Parties, and Impairing the Obligation of Contract, are omitted in this edition, as these are topics which are commonly discussed in the courses on Persons and Constitutional Law in the usual law school curriculum. In many of the cases the statement of facts has, for the sake of brev ity, been either re-written or abridged, without calling special attention to the matter. For the same reason, the practice, now common, of omitting unnecessary portions of the Opinions, has been followed; but such omissions are always indicated. Excerpt from Selected Cases on the Law of Contracts: With Annotations To present any subject of the law by means of cases, is only to follow out the idea of Lord Coke, that the reporting of particular cases is the most perspicuous course of teaching the right rule and reason of law; but in studying the law by such cases, the caution of Lord Mansfield is to be observed, that the law does not consist of particular cases, but of general principles, which are illustrated and explained by those cases. This book has been prepared for the purpose of presenting the general principles of the Law of Contracts, by the study of selected cases, which illustrate and explain different parts of that subject. The cases selected, with one exception, have been taken from the decisions of the Supreme Court of North Carolina. This course has its disadvantage, no doubt, in that perhaps a greater variety of fact and discussion might have been obtained by taking other American or English cases, but it has its advantage, in that it gives a connected view of the whole subject in one jurisdiction. It is not intended to give the law of one jurisdiction exclusively, for. It will be found that the principles of the Law of Contract are the same in all the States which have adopted the common law, and even the statutory changes are similar in many respects. While the student is learning the general law of the subject, he is, at the same time, becoming thoroughly familiar with the decisions of his own State, or of a court which has always met with the highest consideration. This court has been in existence for a cent ury, and almost every important question in the Law of Contracts has come before it in some form for discussion. Its judges have been men-of approved learning and ability. Its views have al ways been conservative; and perhaps in no other State have the principles of the common law been more closely observed. Excerpt from A Selection of Cases on the Law of Contracts, Vol. 2 of 2 The declaration stated, that whereas, after the passing of a local act of Parliament, 26 Geo. 3, intituled An Act for widening, etc., the streets and other public places, and for open ing new streets, markets, and passages within the town of New castle-upon-tyne, etc., and before the making of the articles of agreement and deed-poll thereinafter mentioned, to wit, on etc., a certain scheme was set on foot and entertained by divers persons, and, among others, by T. Featherston, T. Doubleday, J. C. Anderson, J. R. Featherston, and T. Anderson, the de fendant, the then mayor, aldermen, and common council of the town of newcastle-upon-tyne for the time being, and the mayor and burgesses of the same town, viz., a scheme for erect ing and completing, by subscription, in the same town, a covered corn-market or corn-exchange, with avenues and approaches thereto, and for the purchase, by the said mayor, etc., of the same market when erected and completed; and whereas, by certain articles of agreement made and entered into between the said T. Featherston, T. Doubleday, J. C. Ander son, J. R. Featherston, and T. Anderson, being five of the sub scribers, of the first part; the mayor, aldermen, and common council, of the second part; and the mayor and burgesses of the said town, of the third part it was witnessed, that they, the parties thereto of the first part, at the request of the said mayor, etc., for themselves and each and every of them, their and each and every of their heirs, executors, and administrators, jointly and severally did, and each of them did, in consideration of the sum of £5000, to be paid as thereinafter mentioned, covenant, promise, declare, and agree to and with the said mayor, alder men, and common council, and their successors, and to and with the said mayor and burgesses and their successors, in manner fol lowing; that is to say, that they, the said persons, parties there to of the first part, should and would, within the space of four years from the date thereof, make, erect, etc., a covered corn market or corn-exchange, with avenues and approaches thereto.
