A dissertação aborda o conceito de sanção e sua contextualização no Direito Administrativo Brasileiro, buscando definir o ilícito administrativo e sua diferenciação em relação ao ilícito penal, para o fim de abordar o fundamento, a finalidade e os modos de aplicação da sanção administrativa. A problematização centra-se, portanto, na imposição de sanções para infrações administrativas, que têm se firmado como um grande foco da atuação estatal na limitação dos direitos do administrado e na regulação dos serviços públicos concedidos a particulares, além de determinadas atividades econômicas. Dessa forma, são questionadas a viabilidade e adequação da comparação da sanção administrativa à sanção penal, tendo por conseqüência a verificação da aplicabilidade de normas e princípios de Direito Penal à imposição de sanções administrativas. Para tanto, buscou-se analisar desde a origem do poder sancionatório da Administração Pública até o processo administrativo para imposição da sanção, passando pela conceituação da sanção administrativa e pelo poder normativo da Administração Pública, no que diz respeito à positivação das sanções administrativas.
