This volume makes available the most comprehensive discussion and analysis of the law and practice of belligerent occupation which has been published since the first World War. Professor von Glahn, a political scientist, synthesizes the generally accepted principles and practices of military occupation, points out weaknesses of the existing body of rules, and examines proposals designed to bring into existence a more effective system of law to govern the administration of occupied enemy territory. Specialists in international law, military and governmental authorities, and political scientists will find this book valuable for both reference and teaching. A brief historical background section traces the development of the law of occupation. The major portion of the book presents a topical analysis of occupation practices during both World Wars. Among the subjects discussed are many which have been neglected in previous works on military occupation, including the status of collective farms, currency and banking controls, price levels, rationing, and guerrilla forces. Separate sections are devoted to the controversy concerning the legal status of Germany from 1945 until the establishment of the Bonn government and to war crimes trials, both national and international. A significant feature is the text and analysis of the provisions of the fourth Geneva Convention of 1949, which was ratified by the United State in 1956 and which will impose many new responsibilities and restrictions on the armed forces of this country in the event of future military occupations. Illustrative materials are provided in appendixes, and there is a bibliography of approximately 700 items.

Since the mid-19th century military powers and various writers have tried to define the notion of belligerent occupation and, in particular, the beginning thereof. There are many situations in which a state of occupation is controversial or even denied. When is control so effective that an invasion turns into a state of belligerent occupation? What is the minimum area of a territory that can be occupied; a town, a hamlet, a house or what about a hill taken by the armed forces? This paper examines what seems to be an important gap of the Fourth Geneva Convention: contrary to the Hague Regulations of 1907 it does not provide a definition of belligerent occupation. It is argued that the Fourth Geneva Convention follows its own rules of applicability and that therefore the provisions relative to occupied territories apply in accordance with the “functional beginning” of belligerent occupation approach from the moment that a protected person finds him or herself in the hands of the enemy. The arrival of the Allies’ global forces in an Italy torn by civil war brought together populations that had long mythologized one another, yet “liberation” did not prove to be the happy ending touted by official rhetoric. Instead of a “honeymoon,” the Allied–Italian encounter in cities such as Naples and Rome appeared to be a lurid affair, where the black market reigned supreme and prostitution was the norm. Informed by the historical context as well as by their respective traditions, these texts become more than mirrors of the encounter or generic allegories. Instead, they are sites in which to explore repressed traumas that inform how the occupation unfolded and is remembered, including the Holocaust, the American Civil War, and European colonialism, as well as individual traumatic events like the massacre of the Fosse Ardeatine and the mass civilian rape near Rome by colonial soldiers
