This book evolved from our interest in rape as feminists and as sodal sdentists. As feminists, we were concemed about the treatment of rape victims and the attrition in rape cases under traditional rape law, and we welcomed legal reforms designed to improve the situation. As sodal sdentists, we wondered about the efficacy of legal changes aimed at an inherently resistant court system. We also were curious about the lack of studies examining the impact of these changes; we were particularly surprised to find that no one had attempted to ana lyze the impact of the reforms in more than one jurisdiction. Con vinced that untangling the effects of the reforms from the effects of contextual factors required a multijurisdictional study, we deeided to undertake the project. We quickly discovered that evaluating rape law reform in several jurisdictions would be no easy task. We had deeided that such an evaluation would require monthly data on the outcome of rape cases before and after the reforms were implemented, as weIl as qualitative data on the attitudes of criminal justice officials toward the reforms. Because states do not generate monthly data on case outcomes, we would have to collect the data ourse1ves from court records main tained by individual jurisdictions. To obtain an adequate number of cases for the time-series analysis, we would have to select our sites from large urban jurisdictions scattered throughout the United States.

A society’s response to youth crime reveals much about its broader cultural values, social circumstances, and political affairs. This book examines reactions and policy responses to youth delinquency and crime in Hong Kong during its colonial and post-colonial periods, and in doing so, underscores the history of Hong Kong itself and its present-day circumstances. Exploring how officials have responded to youth crime in Hong Kong over time, this book tracks the emergence of a penal elitist mode of governance, highlighting concerns not only about young people’s behavior but the need for officials to establish state authority and promote citizen identification. Resisting Rape Culture tackles controversial and harrowing rape myths prevalent in rape culture: namely that sex workers do not get raped, and that they are deserving victims of sexual violence. Commonly, sociocultural discourses depict sex workers as morally deficient and promiscuous, having sex with multiple clients in exchange for payment. Consequently, they are often considered deserving of rape, sexual assault and other forms of abuse, or as people who should expect to receive such treatment. In a way, the Hebrew Bible contributes to such stigmatization of and discrimination against sex workers, given first, its authority and second, its negative portrayals of prostitutes as outsiders. This cutting-edge book describes the rape culture in Hong Kong, focusing on how Hong Kong Christians interpret the Bible concerning prostitutes, and in turn how this affects the treatment of sex workers. Arguably, when interpretations malign the prostitutes in the Bible, and do not critique how the Bible portrays these women, we promote the stigmatization of sex workers and, in doing so, normalise and trivialise sexual discrimination, abuse and violence, ultimately promoting rape culture.

Winner of the 2008 British Society of Criminology Book Prize Sex offenders, particularly those who offend against children, feature prominently in contemporary law and order debates. Child sexual abuse is a small component of the broader category of 'gendered and sexualised violence' which causes significant trauma for victims yet continues to evade conventional approaches to justice. This is evidenced not only by the low number of prosecutions, due mostly to low levels of reporting and evidential difficulties at trial, but also by the failure of the justice system to prevent re-offending, largely due to the limited availability and effectiveness of prison treatment programmes. Following Braithwaite's dichotomy of 'reintegrative' and 'disintegrative' shaming, this book argues that contemporary popular and state-led responses to the risk posed by sex offenders are largely disintegrative in nature. At best, the offender may be labelled, stigmatised and ostracised from the community, while at worst, he may be subjected to violence and vigilante action and ultimately return to offending behaviour. The failure of these retributive responses means there is considerable scope for exploring alternative forms of justice and their potential for improving the outcome for victims, offenders and communities affected by sexual offences. This book examines the controversy of whether restorative justice can be applied to child sexual abuse as one of the most intractable of contemporary societal problems, and if so, what special considerations might apply. Although restorative schemes with sex offenders are in short supply, a few initiatives have developed in Canada and parts of the United States which have effected significant benefits in 'reintegrative shaming.' The book examines whether such ad hoc schemes may be of general application with child sexual abuse and whether they may be implemented on a more holistic basis.
